After feeling uncertain about our RFE request I checked the USCIS website for informaiton about medical exam and it clearly states that as a K visa: "If you were admitted to the United States as a fiance(e) (K-1), child of a fiance(e) (K-2), Spouse of a U.S. citizen (K-3), or child of K-3 (K-4), and received a medical examination prior to admission, then you do not require another medical examination as long as your application for adjustment of status (Form I-485) is filed within one year of your overseas medical examination. You will, however, be required to submit a vaccination supplement with our adjustment of status application. The vaccination supplement must be completed by a designated civil surgeon."

Well, we did file the papers well in advance of the year anniversary of his UK medical AND we supplied a vaccination supplement. I thought they were asking for another medical because the date had expired before they came to adjudicate his application.

According to their own website he doesn't need another medical. So what do I do? How can I find out why they are asking him to have another one when he had one already within the regulations stipulated by their own department?!

I'm losing it.....everything else in our visajourney has gone so smoothly now I feel like I can't make sense of this bit at all!

Hi, sorry to hear that, maybe u should call your local office and explain to them that maybe they did a mistake or ask them about ur status and find out what u need or need to do, that's the only thing came in to my mind, I hope i helped some.. Goodluck!

If they asked for another medical the safest thing is to just do it! They may have misplaced your old one... or they may just be making things hard for you, but it would be harder if they denied your son's AOS because you didn't send in the RFE.

Hey

I came on a K3 and My son K4 and we had previous medicals in Australia 5 months ago . We also had to have a re medical eval and my son had to have a TB test here in the states . I thought I only had to have a vac supliment as well ..Apparently in the information that immigration gives you when adjusting your status it does say only a suplement form is needed if the medical had been done less then a year .I also questioned the immigration officer about this ..... It just held up the proccess .... I wasnt a happy camper.. However things I have learnt from this is

NOTE TO SELF if they ask for it dont question just do it :D

and look around for immigration doctors some charge through the nose...

I've reached that realistic age where I have to choose between having fun and a heart attack :)

Ask yourself what the purpose of all this is...

Is it to stick it to the man and prove to him that he isn't right...

or

Is it to get through this damn process in as fast and easy manner as possible...

If it's option 1.. then fight getting a new medical and see where it takes you.. If it's option 2, then suck it up and go and get another medical.

I questioned it as far as "OK I was under the impression that blah blah blah " and the officer kindly explained that they may have misplaced my file and it may take several months to find it or longer for it to arrive... I think you are aware of the place where files go after they leave your hands at the gate I think its called Immigration Black Hole :D .

But like perfect I too was under the same impression that i didnt need a new medical unless it was over the 12 month period... As it states

I agree. It's not worth it to try to prove that the USCIS made a mistake. This is just my opinion of course.

If they have asked for another medical I would do it..... there are now at least 2 people on these boards who have been denied AOS for not having another medical done.....

I agree. It's not worth it to try to prove that the USCIS made a mistake. This is just my opinion of course.

Our interview is May 4th in Newark, our letter does not request the Medical or the Vaccination supplement. We did submit the vaccination worksheet given to us by civil surgeon abroad. None of the providers I have called will just do the vaccination supplement, they are insisting on a full medical (yes I am grinding my teeth!!) I have scheduled the damn visit, but $325 later.. this is soooo disheartening!

1/31/18 I-130 NOA 1 received Nebraska Service Center
