Expired K-1-Very Worried!!!

Timeline

My wife came from the Philippines in Jan 2006. We were married in March 2006. All is GREAT! :dance:

Unfortunately, we are just now applying for her adjustment of status. Does anyone have information on what the penality will be for this error? She entered legally and we were married as required, but her K-1 is now expired. Other than this problem, we haven't crossed Uncle Sam in other ways, eg: working illegally or anything like that. I realize the fee's have gone up HUGE and we have downloaded the latest forms for the application. I could kick myself for letting this happen, but it's too late now to cry about it. If you can shed some light on this for us it would be greatly appreciated!!!! THX!!!! :thumbs:

Did you two marry within 90 days of her entry? (I'm guessing so from Jan to March.) If so, just file for adjustment of status as you usually would off of a K-1. It's not ideal to wait this long, but having overstayed a visa isn't a bar to adjusting status based on marriage, and you met the terms of the K-1, so it's no different than if you had married in March and filed in April.

Except the fee increase, of course. :)

Timeline

NOT a problem, file for AOS ASAP.

Note: K-1 expires when you use it the expire date on the K-1 is the last date you can enter the country using the visa. The I-94 expire date is the period you are concerned with for marriage within 90 days.

Is now a US Citizen immigration completed Jan 12, 2012.
