Hello to everyone!

Really got confuse on that and dont know what to think!My petition in California center,NOA 1 from 7 may 2007(it,s more than 4 months now),but yesterday boyfriend said to me he received one letter from USCIS...they want some more paper and 450$ to pay.......what is this???? Who have any idea...really need help!!!!!!!!

Is it possible that your fiance forgot to include the $170.00 fee when he filed back in early May? The rates changed. As of July 30th the new fee is $455.00. But if he forgot to pay, they should have rejected your petition or requested the money soon after receiving it. Did you personally see this letter from USCIS? You can check the status online with your case number and actually see this letter from USCIS. If I were you I would ask him to give you the case number and look into this. Sound s alittle odd to me. But maybe not...Good luck to you, though.

14 July 07 - I-129F and all related documents sent to VSC

16 July 07 - I-129F delivered to VSC and signed for by P. Novak

20 July 07 - NOA1 issued / receipt number assigned

27 Sep 07 - Jason travels to Moscow to be with Sasha for 2 weeks

28 Nov 07 - NOA2 issued...TOUCHED!...then...APPROVED!!!

01 Dec 07 - NVC receives/assigns case #

04 Dec 07 - NVC sends case to U.S. Embassy Moscow

26 Dec 07 - Jason visits Sasha in Russia for the 4th and final time of 2007 :)

22 Feb 08 - Moscow Interview! (APPROVED!!!)..Yay!

24 Mar 08 - Sasha and Jason reunite in the U.S. :)

31 May 08 - Married

29 Dec 08- Alexander is born

11 Jan 10 - AOS / AP / EAD package sent

19 Jan 10 - AOS NOA1 / AP NOA1 / EAD NOA1

08 Feb 10 - AOS case transferred to CSC

16 Mar 10 - AP received

16 Mar 10 - AOS approved

19 Mar 10 - EAD received

22 Mar 10 - GC received

Is it possible that for some reason the petition was rejected? If you have the case number, should be WAC###, may I suggest that you look it up and see if they rejected it? It gets kicked out for wierd reasons, one of the most common is if you, the beneficiary, did not sign your G325A, or did not put your parent's birthdays and place of birth, or if he, the petitioner left out similar information. If they did reject the petition, then that case number should indicate so. In a few days, if he is in fact re-filing, there will be a new case number assigned. Sorry to hear that, it sounds like a setback (shuddering to think of a setback like that). Good luck to the two of you.

It sounds like the petition was turned back and a refile would now require the new fee rate

Yes, it would appear some critical document or documents were not included. Instead of requesting them, they've returned the petition with instructions to file again with the appropriate documentation. This would require the new fee be paid.

Facts are cheap...knowing how to use them is precious...

Yes, but if it's rejected then the whole petition and payment enclosed would have been returned. It doesn't make sense that they kept it, issued an NOA1 and are now asking for more fees/papers. If a petition is rejected the whole thing is returned and no NOA is issued until resubmitted with proper fees/documents included.

We would need to know exactly what the letter said and if the whole petition and original fee was returned to even venture a guess what it is about.
