Gary, if you saw an illegal immigrant walking down the street and you were certain they were here illegally, what would you do under the current circumstances?

Ok, so overstaying a visa is a civil offense, not a criminal offense? In general, whats the difference between a civil offense and criminal offence? Is there a seperate set of rules/laws that make an offense criminal as opposed to civil?

A civil offense is usually punishable by a fine and maybe a short stay in jail. In regards to illegal presence it is usually only punished by deportation. A crime such as illegal entry (ie. walking across the border) is punishable by up to one year in jail generally. Coming back in after being deported or a second offense of illegal presence is a crime and can get you a year or more in the slammer.

They are booked with an INS number and detained until they go to court and then sent back to their country of origin as soon as possible. If it's not their first time, they are given a US Marshall (federal) number and they do federal time. I don't know if what Guiliani says is true or not, but I do know that these offenders do federal time on criminal charges.

ok let's say you make illegal immigration a crime.. how the heck are you gonna know who is an illegal and who is not? just pulling random furriners on the street and asking for ID?? I know that you could do the raids and whatnot in workplaces, but, on the street? hey look officer, I saw a guy over there speaking spanish, he's probably an illegal, why don't you arrest him..

as someone who is from the anti-illegal 'cheering squad' would say.. '80% of the illegal population is from latin-america..blablabla'.. you know these vj folks.. cmon..
