"It's not a crime," Giuliani said Friday. "I know that's very hard for people to understand, but it's not a federal crime."

Giuliani's comments came in an interview with CNN Headline News and radio talk-show host Glenn Beck.

"I was U.S. attorney in the Southern district of New York," he said. "So believe me, I know this. In fact, when you throw an immigrant out of the country, it's not a criminal proceeding. It's a civil proceeding."

Illegal immigration shouldn't be a crime, either, Giuliani said: "No, it shouldn't be because the government wouldn't be able to prosecute it. We couldn't prosecute 12 million people. We have only 2 million people in jail right now for all the crimes that are committed in the country, 2.5 million."

That's gonna make Gary nauseous... no wonder he's betting on Lazy Fred.

Or he's just pointed out what the law is. Civil offense, not a criminal one, and it's heartening at least to see he recognizes that. I wish he'd had a better answer: that 'sanctuary city' means 'people aren't afraid to talk to the cops so I could be tough of crime.'

Illegals should still be deported.

"The fact that we are here today to debate raising America’s debt limit is a sign of leadership failure. It is a sign that the U.S. Government can’t pay its own bills. It is a sign that we now depend on ongoing financial assistance from foreign countries to finance our Government’s reckless fiscal policies."

Most any other GOP candidate would have been unable to resist couching it in red-meat. Certainly a Fred T or Brownback would never use the words "is not a crime" and they sure as he11 would not have said it shouldn't be.

As had been pointed out before, ENTERING illegally is a crime punishable by 1 year in jail. Re-entering after being deported is a felony. Illegal presence is a civil violation. But omitting those that came in on a valid visa and overstayed the rest have committed a crime.

Ok, so overstaying a visa is a civil offense, not a criminal offense? In general, whats the difference between a civil offense and criminal offence? Is there a seperate set of rules/laws that make an offense criminal as opposed to civil?

A civil offense is usually punishable by a fine and maybe a short stay in jail. In regards to illegal presence it is usually only punished by deportation. A crime such as illegal entry (ie. walking across the border) is punishable by up to one year in jail generally. Coming back in after being deported or a second offense of illegal presence is a crime and can get you a year or more in the slammer.

That is one reason why I am not supporting Giuliani. I am not saying we should throw 20 million people in jail but if being here illegally was a crime then the local police would have a reason to hold anyone they find to be here without permission. It would stop all "catch and release" and "sanctuary city" policies.

Gary, if you saw an illegal immigrant walking down the street and you were certain they were here illegally, what would you do under the current circumstances?

I would shoot them with a harpoon and install a tracking device on their skin.
