OK HERE IS MY QUESTION,,,NOW IAM WAITING FOR MY I-130 TO GET APPROVED,,,IF I GETS APPROVED,,IS THERE ANY CHANCE TO OBTAIN AN ADVANCE PAROLE TO ENTER THE U.S BEFORE GETTING THE VISA OR DEAL WITH THE NVC?MY WIFE HAVE A SERIOUS MEDICAL CONDETION,,IS THERE ANYWAY THAT I CAN GET ADVANCED PAROLE OR HUMANETARIAN PAROLE ?I WANNA WAIT FOR THE I-130 TO GET APPROVED SO MAYBE THIS WILL MAKE ME LOOK BETTER ,IS THERE ANY CHANCE?PLZ I NEED AN ANSWER

I think you sort of misunderstood what and advance parole is. If you are in a foreign country right now you cannot really obtain an advance parole. You can only enter the US on a visa. I suppose a visitor visa should work. I hope others will help with that. From what I understood an Advance parole is given when you're already in the US on a K-1 visa for example (K-3 doesn't have problems with traveling) and you want to leave the US before you get a green card

ur right ,,but yes u can get advance parole if ur outside the u.s and even if u never been there before,,advance parole is for ppl who's allready in the u.s and they want to leave to c ther famly's overseas and it can be used also for ppl who's outside the u.s and they wanna get it to enter the country ,,and usually its valid for 1 year,,i know ppl who got advanced parole while the'r immigrant visa process was still pending,,and then later they left the u.s when they went back for ther interview,,and u can get it also at the port on entery,,like the boarders,,thoes guys at the boarder have the authoroty to give 1 year permint to anybody they want,,,but offcourse if u have a good reason,,,thnx anyway

A visitor visa is a possibility in the case of a humanitarian emergency. My wife's friend was able to get one but the Consulate was well aware of her husband's medical emergency. He needed to be evacuated from China to a US hospital to have his leg amputated.

I would check with the nearest US Consulate by email or fax for the recommended procedure. I'm sure it would involve documenting the specific circumstances.

Facts are cheap...knowing how to use them is precious...

Ummm...I am not an expert on advance parole, but this does not sound correct to me. As far as I know, advance parole is only available to aliens on non-immigrant visas already IN the States legally. Potential parolees are requesting leave to travel abroad and then re-enter before AOS has been granted. This is why those who enter on immigrant visas (IR1/CR1) and those with multiple-entry non-immigrant visas (K3, for example) do not need AP. The K1 is a single-entry non-immigrant visa that needs to be adjusted for the alien to achieve permanent residency.

It is not available to those who have never been to America, and it is not available at the border. If you want to visit America before or after your I-130 has been approved, you need a tourist visa. Think about it -- why would US immigration give you clearance to exit and re-enter the States before you even arrived in the States in the first place? :blink:

Whether or not you will be approved for a tourist visa is another matter. You may be eligible for humanitarian parole -- I know little about this, but here is the info from USCIS on that matter: http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

Note the paragraph that states: Humanitarian Parole cannot be used to circumvent normal visa-issuing procedures, nor as an instrument to bypass preference immigrant visa availability or processing for refugee status. Parole is an extraordinary measure, sparingly used to bring an otherwise inadmissible alien into the United States for a temporary period of time due to a very compelling emergency.

Perhaps someone else can shed light on that matter, but as it stands you are not eligible for advance parole.
