Timeline

My husband and I filed for Adjustment of Status for him. We have our interview date at the end of this month. My husband has received advance parole and we are planning to go to see his family in italy. However my husbands passport expired this month and without thinking he sent the expired passport containing the visa he came here with and his I-94 to the Italian Embassy so he could get his new one. On the notice we recieved from USCIS it says that we must bring it with us. We have copies of it, but not the originals now. It states on the notice that we will be denied if we fail to bring everything with us. What can we do at this point? :help:

You could try calling the Italian Embassy and finding out what the situation is. Ask them how long it will take to receive the new passport. They will also send the old passport back too.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

I don't know about italian passports but Turkish passports have pages on them reserved for extensions. So if your passport expires, you pay the appropriate fee and get a 1,3 or 5 year extension and they just fill those pages.

If this is the case, then you'll most likely just get the same passport back, but if they're gonna send a whole new passport, then definitely call up the embassy to see if you can get the old one back as well. You're definitely gonna need that one.

Good advice about contacting the embassy and finding out how long it will take to recieve a new passport. I'm pretty sure that you won't need the original visa or I-94 now that you've filed for AOS and received your advanced parole. Just be sure to bring those documents with you. If i'm mistaken about this, i'm certain that someone will correct me. Best of luck. My wife and I are also playing the obtain a new passport game heh..

Is there something on your interview appointment form that allows you to ask for a reschedule? You can also try an infopass appointment. I wouldn't trust the customer service center for that.

I hope the Italian embassy is a bit more efficient than the Russian embassy. We went my wife's passport in for renewal in March and we still don't have it back yet.

From what I've read before it is not a good idea to reschedule the interview. I would try to contact the Italian embassy ASAP, explain the situation and get the passport back. Good luck to you!

I forgot to bring my passport and I-94 to the interview, and I got away with it :) The IO said that since she had copies, it was sufficient. However, it's better to have a passport at the interview.

I wouldn't reschedule because you don't know how long you'd have to wait for a new interview date. Try and get the passport back though and maybe try to expedite the request. You could always send the embassy a copy of your interview letter as well.

Do you still have photocopies of the visa and I-94? Does your husband have any other ID on him? I know when I went to my interview I had to show ID (all I had was my passport) to the security guard to be let into the building.

We do have photocopies of the visa and I-94, I guess we will contact the italian embassy, then go to the interview with or without it. We can always appeal if they deny it right?

I wouldnt re-schedule. I would think that if the IO needs to see your passport they would issue a RFE for it, you would then have 90 days to produce it.

The only thing I can think of, is if you need it for ID purpose ie if it is your only photo ID as you do need that to get in the building.
