hello everyone...okey me and my husband are having a hard time deciding if we need a co-sponsor for our affidavit of support... our situations goes this way....

when i arrived here in the US my fiancee(USC) got sick and had to be confined but fortunately he is out now and okey the problem now is they had to let him go from his work( the company provided employment certificate and proof of income which we used during the K1 application process) but then, now he got a new job but barely started though, he is getting paid more...18/hour which is above the poverty line if computed. thus, the past three years he had not been filling for ITR because he had been a student. and in the affidavit of support it said he has to show ITR. question now are:

1. do we still need a co-sponsor because he cannot show ITR for the previous years even if his income now is way beyond the poverty line?

2. will it affect our AOS application if in the K1 we used diffrent proof of employment (different employer/ company)from what we will use in the AOS application now?

any replies and opinions will be highly appreciated.....CHEERS and more power to VJers..... :):):)

I do not believe changing employers will be a problem, but not being able to show that he earned the minimum income through tax returns could very well pose a big problem. I would call USCIS customer service and ask to receive a definite answer. Good luck!

Changing employers will probably not be a problem. I got a new job just after my hubby's Consulate interview and submitted the new job info in our AOS packet, no issue about it so far.

If you have an eager and willing co-sponsor, i would suggest using them. Better safe than sorry and the more paperwork submitted, the better, during this process! Good luck!
