hi to everyone, i have a question here regarding my husbands bank statements. he just told me that before we got married he put her sister as his benifeciary if something happens to him. now that we are married, is it authomatic that i will be going ot be the benifeciary or my husband still have to change it? and for example my husband will not change it,who will be the one to have a rights with his money me who is the legal wife or the sister?

He has to change it.

My husband had to do the same thing.

It's up to your husband to decide who he wants as a beneficiary.

In the part under banks I would presume that a named beneficiary would have right to the account if it is only in his name.

Having a will made up is always a good thing, that way there are no surprises and the deceased wishes will be honoured.

The answer to your questions depends on several things, including whether or not you live in a community property state.

I would first ask the bank, although I would not necessarily trust the information. More importantly, I would ask an attorney. I doubt that it would cost that much. In fact, there may be free legal aid in your state.

I can tell you that I would not feel comfortable being someone's beneficiary as named in their will while the bank account had a different named beneficiary. I would be surprised if the account had anything other than a zero balance by the time you got around to producing an enforceable will.

See an attorney.

Well, if it's a joint account the account holders would have rights for the account first - the beneficiary would, I assume, have rights if neither one of the account holders had the ability to make decisions regarding said account. Kind of like my life insurance - my husband can't touch it if I'm here, it's only when I die he gets it.

He will definately have to change it himself. But why wouldn't he change it? Have you gone to your interview yet? They may ask him that question and he needs to be prepared to answer it. The account you have together, you can change it since it is in your name too.

They may still need his auth as well - when my husband added his SSN to our bank account, I had to sign something okaying it. (Don't ask - BofA is weird.)

I think what you have to do is to discuss this with your husband. It's up to him to decided where what goes, but if you feel worried about it talk about that issue. He is the only one who can decide to have things changed.

He definitely has to change it. I just noticed that my ex was still on one of my retirement accounts so had to get it removed and Claudeth added.

10/25/2010: Request for evidence recieved "Biometrics Notice".
