Hi all, first post here.

I'm fairly independant minded, and generally don't ask for help (a bad point of mine) so we've gone ahead and completed our I-130, I-485, I-765 and related forms, but we're left with a small question.

Background info: Wife entered country in 2005 on Student F-1 visa, I met her in late 2005, started dating in 2006, popped question and later got married in 2007. She's been going to school and renewing I-20 and whatnot the whole time, so we're pretty sure it's ok.

Anyway, when I went to the local INS office and asked about applying for a greencard/AOS they handed me a fairly thick packet of stuff with a nice checklist on the top.

Since she entered the country legally and has remained in the country legally, it seems that we can file the I-130, I-485 and I-765 all at the same time.

The checklist the INS officer gave us seems to be geared towards this route, and lists everything you need for the I-130, I-485 and I-765 on one list, with no demarcation between the required documents for each individual form. This checklist only asks for 2(two) passport style photos of my wife(the immigrant) and 1(one) of me.

If I look at each form seperately, though, I find that:

The I-130 asks for 1(one) photo of me and 1(one) photo of her

The I-485 asks for 2(two) of her

and the I-765 asks for 2(two) of her

Should I simply follow the checklist I was given at the INS office and send in 2(two) of her, or should we be #######-retentive/safe and send in 5(five) photos of her?

I'm thinking 5(five) would be good.

Also, the I-130 form instructions state that you should write the names of the people on the back of the photo in pencil or felt pen.

The I-485 and I-765 instructions just mention pencil.

When we write our names in pencil, it's practically impossible to read.

Should we just use felt pen for all?

Or use pencil and just try to find a better pencil?

Each application needs to be able to stand alone.... treat it as if you were sending them in seperately....so yes you would aggregate the sum total of all requirements for all applications...

What about the pencil vs felt pen question?

legible I think is more important so I would go felt on all....

consider two per application is the norm. :jest:

This has nothing to do with your question, but being able to file the I130 and I485 together has nothing to do with remaining in status ('remaining in the country legally') - overstays can do it as well.

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!
