Anyone see any red flags here?

Hello All,

I have some issues that may be out of the ordinary and would like your feedback about them. Specifically I would like to know if any of the issues below require additional documentation or explanation to avoid RFE or other delays. Thanks for your help!

Grid

1. I sponsored my soon to be ex-wife for permanent residency about 8 years ago.

2. I will submit the I-129F petition for my fiancé a week or two after the divorce is final. Will this short turn around raise any questions? Do I

need to attach an explanation or is it a non issue?

3. My fiancé is a Ukrainian citizen who had lived and worked in Italy for about 8 years. During this time she was in a common law marriage

with a man who is now deceased. Do she need to give an explanation for her reasons for applying for a visa? Will her denials affect her

chances of getting the K1 visa?

4. During her stay in Italy she applied twice for a visa to accompany her common law husband to the US for medical treatment, but she was

denied on both occasions. Are any documents or explanations necessary here?

5. She now has permanent residency status in Italy, but lives in Ukraine. Again any red flags here that require explanation?

6. She currently has an arraignment with a friend in Italy, who employs her solely so she can keep her permanent residency status in Italy.

(Apparently one must work and pay taxes to keep this status). Red flags needing explanation??

My opinion:

1) No

2) Not for the petition, maybe questions will arise at the interview

3) No

4) No

5) No

6) No

In short, I would agree. I like short but some of my answers would probably be, "It depends". You should be prepared for extra scrutiny of bona fides. This scrutiny could extend to all the issues you mention, so she will want to be prepared to address them with confidence at interview. Of course, it is also quite possible there will be no complications whatsoever. Recent divorces seem to be bigger red flags when the USC's income is low. Another "It depends.".

No.. but I will tell you that in Kyiv, if your documentation package is complete and well organized in all liklehood you will not be questioned extensively.... It is a great consulate to work with.. I cannot stress enough... do not short cut your documentation...

My soon to be ex-wife emigrated from China to Canada several years before we had met. She was a Canadian citizen when I sponsored her for permanent residency in the US.

My soon to be ex-wife emigrated from China to Canada several years before we had met. She was a Canadian citizen when I sponsored her for permanent residency in the US.

Then I don't see the alien part as an issue but the recent divorce could be. There are so many different items little potential issues, it's hard to think none of them will cause some extra scrutiny.

I should add that my petition for my soon to be ex-wife was not for a visa. Before I met her, she already had a visa that allowed her to move to the US and to establish her import business in the US. After we married I petitioned for an AOS to permanent residency. Is this perhaps less of a red flag??

There is at least one other individual with a Ukrainian fiancee who filed shortly after his divorce was final. His petition was approved and is now in transit to Kyiv. I would stay tuned to see what his experience at the consulate is and then draw your own conclusions.

Anything you asked about in your original post could be scrutinized. I'm just saying that because there are so many different issues you asked about, that the combination of all of them could bring scrutiny to any or all of them. None of them are reasons for denial unless they don't like the explanation given. So, it is wise to have a clear and concise explanation for all.

The issue of your recent divorce in combination with the other factors is the most concerning but, of course, there's nothing wrong with being recently divorced, in and of itself.

Your fiance is going to have multiple (perhaps only two but more than one) police report, two previosly denied visa applications on file and a recently divorced fiance. She could skate through or be asked about it all.

I can't help with answers, but just wanted to mention that I have very similar concerns. I also petitioned for my ex 5 years ago (also for AOS). I submitted my K-1 petition for my fiance (Ukrainian as well) just 5 days after divorce was final. Moreover, my fiance now (for whom I am petitioning )-is my former husband. We divorced 15 years ago, just before I immigrated to America from Ukraine. The worse part in addition to everything above (as I think...,might be wrong...) that I have my ex's name on all my tax documents .

I totally lost my sleep thinking of how many red flags I am having...

The only thing I can offer that may be informational to you is to watch my path, since I filed in May, and have NOA1 from early June
