I really couldn't search for RFE's in the AOS section. We just got an RFE for :

F.(40) The sponsor or joint sponsor (if required) on Form I-864 Affidavit of Support must submit the following:

- W-2's, 1099s, and/or all schudles submitted to the Internal Revenue Service (IRS)- a copy of his/her Federal income tax return was submitted and/or the sponsor or joint sponsor requested an extension to file his or her Federal income tax return.

I sent in a copy of only my 2006 tax returns with W2. I'm not sure why I got an RFE when the instructions say to send in my latest tax return and I'm above the 125% requirement. What do you guys suggest I send in this time for my RFE? I'll include a copy of my 2006 tax returns and W2s again. but do you think I should send in my 2005 and 2004 tax returns and W2s? Should I send in pay checks also? thanks

Did you have a co-sponsor ? We received the same RFE as unbeknown to us our joint sponsor had not filed the 2006 taxes on time and had asked for the said extension .... We sent in the W2's for the previous 3 years for my USC partner and my co-sponsor plus the two W2's I had received since being here....the co-sponsor also had to provide the1099 for 2006 and the info. sent to the tax office regarding the late filling of taxes

I sent in 3 years of tax returns and W-2's. By the looks of it, it is asking for your or your sponsor's tax return etc again. To be on the safe side send 3 years. Better to have more info for the I-864 than not enough.

Did you really file for extension or not? We got the same RFE and also didn't understand what exactly they want. However, my husband did file for an extension. So, if this is your case, let me know and I'll tell you what we sent them.

In any case an infopass appointment might be useful. That's what we did with our RFE.

We had the same RFE. Though, I sent the returns with the original application (not 100% complete), I resent the 3 years of tax return including all W2's and docs that were filed with the tax return (now 100% complete including ALL pages). Also sent 3 years return (100% complete) for the joint sponsor. No extension filed.

They sent a notice that we satisfied the RFE request. :dance:

We had the same RFE. Though, I sent the returns with the original application (not 100% complete), I resent the 3 years of tax return including all W2's and docs that were filed with the tax return (now 100% complete including ALL pages). congratulations on EAD approval!

Are you self-employed? Is that why you sent 3 years and not just the last year tax info? I am only guessing that we all get the same RFE notice for tax, as OP quoted. They don't tell you what exactly they want you to send or resend! Why was your info "incomplete" - What was missing from your original appl?

Just trying to figure out what my chances are - we got the same RFE but I failed to send my husband's W-2 (Duh!!!) first time around so I thought that's all they wanted! And I sent copy of only last year tax return. He makes way above poverty line, has only W-2, no 1099 it all seems straight forward.

Is there a clear cut on when to send 3 years and when 1 year tax info is enough???

Well, my original application did not have the complete tax returns - I only sent copies of the first few pages and the last one with W2's copies as well.. I thought they will see the whole package at the interview.. but I guess that wasn't enough. I'm not self employed. I sent 3 years because, the previous 2 years, I was not working or barely working not meeting any POV line. And of course, I needed a Joint Sponsor which I included the 3 years.

I thought it's better to send more than less in my situation.

No assets or bank account info was sent as well.

Hi ! I got the same RFE today :(( I had sent the tax returns for 2004-2005-2006 alongwith 2 months of paystubs and letter from emplyer. I wasnt aware I had to send the W2s since the tax returns were being attached..anyways...i want to check that now I should send the W2s for the 3 years from my sponsor (I dont have any co-sponsors) and 1099s from the bank for his interest payments? Do I need to include anything else?

Are you sending all the pages of the tax returns or just the main 2 pages? I ahd sent the 2 pages for each year.

I have 1099 for just 2006 and W2 for the last 3 yrs...will that work?

that's what I would do. something similar happened to us. I was told at the interview what I originally sent with the application was correct. this seems to be happening alot. I think some of the adjudicators need a refresher course on what the current requirements are for the I-864 :yes::whistle:

One year of tax returns is sufficient. You can just send the same stuff again, but if you want to play it safe, send them 3 years of returns. The more the better.

BTW, we only sent one year, and when we got an RFE, we re-sent the same year of tax info. They accepted it without any questions.
