October: Waiting

November: Waiting

December: In Security checks

January 2006: Waiting

February: Waiting..Contacted Congress

March 4th: APPROVED

March 17th: NVC posted file to London

March 20th: London Receives file

March 29th: Receive package 3

April 13th: London Receives package

April 19th: Medical - June 13th: INTERVIEW......APPROVED!!!!

June 20th: ARRIVE IN USA

Time taken for whole process 9 Months

November 3rd: NOA1

November 14th: Snail mail ~ NOA1 ~ Case moved to the CSC for faster processing.

November 14th : CSC has petition for me and my daughter.

December 14th: Biometrics completed.

January 17th: APPROVED AOS!

January 22nd: Green card arrives in the mail:))

Time taken for AOS - 3.5 Months

Finished for 2 years.

WOM takes a very long time and you may be out of checks before you would have an answer.

Have you tried directing a complaint to the following offices ? Here are addresses for the OIG and OIA :

No I have not filed a complaint with any of these offices. I did not even know they existed. I will look into this now thank you. I hope they can get stuff rolling for us. Is there a particular preson I should address my letters to?

I am so sorry for your situation! I know how hard this must be for you. It is totally unacceptable to wait six months and then not taken seriously by the people at USCIS.

I have heard that some people have filed law suits against the FBI. Writ of Mandamus. It is for people that have waited an excessively long time. However, you should first exhaust other means of resolving this problem by writing the Immigration Service and State Department. I think an immigration lawyer could draft a good letter - or - you, if you good at legal worded letters. Then send these letters via certified mail so you receive notification of their receiving the letters.

Wait for a response from them. But I would only wait 3 or 4 weeks.

If you do not get some response from them, then it time to contact an immigration lawyer to find out how to proceed with a Write of Mandamus.

Sometimes, I hear the FBI exipidites checks if there is a pending law suit against them on delaying.

No nothing just to wait and contact USCIS again in 6 months.

There is another way albeit a very radical one. Divorce your spouse and then file for a fiance visa. They don't do name checks for that until you file for AOS. By that time your SO is here and at least you can wait together. I know this is probably something you won't consider but it's all I can think of to tell you. Sorry for your hard time. I hope things work out quickly.

It's my understanding the hold up on the case is due to FBI security checks. Fingerprints or name checks. So I don't think divorce and re-filing is a good suggestion because the poster will still have the problem of the FBI delays.

There have been stories of US greencard holders (already living and working in the USA) waiting to become naturalized who have been waiting years for the FBI to finish security checks on them.

Seems rather stupid that it can't be processed sooner for people who already reside in the US.

Ok confused here.

I talked to the lawyer and now she said that she will give it 3 more weeks before contacting USCIS again. Then she said my only option after that would be a Writ of Mandamus. Im confused here as to why she would recomend that. I I was under the impression that USCIS is filing a suit againt all WOM even for people in AOS. Does this lawyer know what shes talking about or are they trying to scam money that I dont have out of me? I dont want to pay money for something that I know is no longer works or is appropiate for my situation. Is there something that I dont know about WOM's? Should we look for another lawyer?

Wow, seems like a stretch for Mandamus. From what you have written there seems to be no time certain to produce results. I can see where Mandamus could help but it might be a rocky road. If you want to go Mandamus I can send you a sample WOM I filed if you are interested in tackling it yourself. I imagine a lawyer would charge a fortune for this as I believe it will be filed in US. District Court. (I'd have to check into the jurisdiction issue)

You are getting a lot of good advice here without going with Mandamus and I would use it (WOM) only as a last resort.

Calling an illegal alien an "undocumented immigrant" is like calling a drug dealer an "unlicensedregistered pharmacist". (because somebody gives a damn)

That's such a horrible situation to be stuck in. I hope the suggestions above help to get your case moving forward.

One thing that might be worth thinking about (at this point) is: Do you have your hearts set on living in the US together?

An option might be to live in the UK for a few years and then meet the criteria to DCF. That way there is no separation for the two of you, even when filing for the US again. I know if I had been waiting as long as you have, I would be greatly thinking about immigrating the other way. Being together with my other half is more important than where we live. America would give us a better quality of life than we would have in the UK but being apart from your spouse (for an unknown period of time) ruins any positives in either location :(

Thanks again every one for your input. Im trying to exhaust all my resources to get help on our case. So far nothing, but I can say that God is the one that is keeping me sane these days. Im at the point where I just feel its all in Gods hands now. The immigration lawyer that we have (not a good one at that) ball parked 10k for her or some one she knows to do a WOM. She said that since our applications are in California that we should file the WOM in Calirfornia. After she gave us that price we pretty much gave up on that. We live from pau check to pay check and there is no way we could come up with 10K. Some how God is going to help us, I know he will. Please keek us in your prayers.

I haven't read everyone else's responses, but get congressional help and don't pay attention to what the USCIS says.

CALL THEM DAILY IF YOU MUST.... Bug the ###### out of them. Make them realize you're there. Good luck to you on your continued journey. I'll be hoping for the best.
