There is another way albeit a very radical one. Divorce your spouse and then file for a fiance visa. They don't do name checks for that until you file for AOS. By that time your SO is here and at least you can wait together. I know this is probably something you won't consider but it's all I can think of to tell you. Sorry for your hard time. I hope things work out quickly.

Thanks every one, Im just lost today. I feel like a robot. I really dont know what to think say or do. I thought about sending an envelope to USCIS as an RFE with evidence of a bonofide marriage (with pics, emails, letters, insurance, banking, ect) but it's been over a 1 yr if they wanted additional evidence they would have sent us the RFE by now. Also people told me that the chances of my package getting to the right file are slim when they did not request an RFE. I just thought that maybe if I labled the evelople RFE like they request, it might get matched up correctly. I dont know what else to do. I wish they would let us move on as we still have more than half a journey to complete after we leave USCIS. Honestly Im scared of NVC now, but at least you can call them and ask about the status of the checks, we cant even do that here. They wont tell us jack. Any one else got stuck in USCIS hell of "additional review" from the start like we did?

I got a reply from my sentor back in July, saying that there is nothing they can do and that "some times these cases take weeks, months, or years to get resolved, and in some cases some of them never even get resolved." That last part really gave me losts of hope. I was better of not knowing that.

Have they ever actually transferred you to the service center your petition is at? Do you have a case number even?

Yes we got a case number from the CSC. The status on line has not changed on that since the day the recived it. Also many k-3s got transffered out of the chicago lock box because they are no longer preocessing I129F's there for married couples, mine never got transffered. =0( I never got a notice of then sending it any where nor did the status ever change online either.

Congressman -John Culberson-said he cant help as Im not I'm out of his jurisdiction, reffered me to Michael McCaul

Congressman - Michael McCaul- took about 6 months to reply and pretty much gave me that ####### response of there is nothing they can do and that "some times these cases take weeks, months, or years to get resolved, and in some cases some of them never even get resolved." I was so upset I cant even find that stupid reply letter because I must of got rid of it after a read it with my own eyes. I remember the words clearly of that sentance because a staff immigration aide called me at work and read the reply to me over the phone. When she read that bit of the letter thoes words just stayed braned in my head. A week or so latter I got a hard copy of the letter in the mail and I think I lost it or trashed it after reading it again.

The only one that has been the most helpful has been

Senator-John Cornyn. He took about 3 months to reply. His reply consisted of a copy of an email that he got from DHS. It reads as follows:

The processing of your case has been delayed as USCIS is currently awaiting the results of required security checks. Its pretty much what USCIS kept sending me in the mail saying our case requires "further review" and to get back to them in 6 months if we have not heard any thing. At least I got to see the whole reply not just the one vauge response witn no information what so ever from USCIS. Senetor Cornyns staff was the ONLY one that really helped and got back to me fast and with an actual response compared to other representatives. Sept 20 will be 6 months from the time that I got this letter so I will be contacting them again wtih hopes that they can do a possible follow up. Thats the only thing that Im hanging on to. I hope they can come back with some good news of some and progress.

Actually, that's not a half bad idea.

I'd rather do that than be in the USCIS black hole. But, I'd consult with an immigration attorney about it before I did it - to make sure I wasn't shooting myself in the foot.

Quite untrue, especially for those of us with muslim SO's. We went through 8 months of security clearance prior to receiving the K1 visa, and now stuck in namechecks for AOS for nearly 2 years.

UGH. Well scratch that then. I knew they did some checks prior to approving the K1 petition, but I did think they left the more thorough ones for AOS.

Seriously, with the answer from that senator and the whole case I would contact your local media. They will love to publish this story and you will finally get some help. The congressmen and senators of course can do something, this guy just doesn't want to. Go public, it is your best bet.

Please consider that quite possibly you got a canned response from your congressman/woman. Have you written your state reps? Your senators-both of them and your state representatives?

I hate to say this but...don't rock the boat unless you have to. there are a lot of people in the queu and is it possible that your actions might negatively impact them? I would send of both sets of finger prints to get info for your self and for your congressmen. That is something you can do and it is something you might want to know.

It appears to me that something is going on-name sounds like someone else, pakistan, something is hanging this up--you goal is to find out what the snag is--your representatives should help you find the snag.

In Feb I received a letter that I should wait 6 months before contacting USCIS again for any update if I had not heard any thing by now. Well today happens to be 6 months. I called just now and still the @!#$!@#!@ at the call center never escalate my call. I don’t know what else to say and do. I have tried it all. I told the person on the ph that its been over a year and I still have no NOA2, and that the last time I called I got a letter telling to call back to speak to an immigration officer, if I had not heard any thing regarding my case in 6 months. Still the @#!@!@ would not escalate my call. Then I said to her that I wanted to speak to them to check the status on the on going checks. And I also mentined that USCIS is currently processing applications filed in 2007 and I have a receipt from June 2006 and still nothing. I got the typical BS canned response u will get a letter in the mail in 30- 45 days. AGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGGG HOW can I do it to get escalated please TODAY IM DESPTRATE.

Then I found a number for the FBI information division and I called them too and the girl said "if this is for USIC we can’t help you with any information regarding the checks". I asked her is there was any way to get a status or any thing we been waiting for a over a year to get a reply from USCIS and she said. No it takes any where from 6 months to 6 years. With that she knocked my will of living and I said thank you and hanged up. Now I’m sitting here at my computer at work crying my head off. Should just send my hubbies and my finger prints along with mine while I’m at it and request the FBI information record our selves. Their website says if you send in the $18 payment it takes 16-18 weeks to get the results. Is this a good idea? Any one ever done this before? I heardFOIA is a waste of time and money as they take over a year or more to reply. Besides the FBI are the ones doing the checks for USCIS in the first place. Has any one here requested it and what was the actual turn around time? Was it helpful? Will it makes things worse and pro long my NOA2 even more? Im looking for peoples first hand experince who have requested this.

I feel like a starved stray dog right about now waiting to get any scraps or get bone tossed at. Any thing would do me some good right now any little bit of help or insight on their famous "futher processing or administrative review" would do. Why can’t these people at the call center just have a day off at being @!#!@#! for once in their lives and escalate my call to some one who knows what they are talking about? The person told me that they can’t escalate me because when she typed in my information on the screen the computer does not alarm her to escalate my call. AGGGGGGGGGGG.

The FBI web site says “The FBI will only respond to status inquiries from its customer agencies. Please contact the organization receiving your original application. In Citizenship and Immigration cases, contact USCIS for the status.†Yet when you call the stupid USCIS they don’t even talk to you. They just send a stupid canned letter we are doing further review of your case,!!!!@$%#$@#$@!$@#@#$ Is any one else in this never ending cycle of no information and even senators say they cant help you like we are? We are going around in circles, that’s why I thought that maybe its best I send the stupid 18 dollars and become their “customer†and get some type of answer from some one. I was patient for 6 months like they asked and today was my that I was finally allowed to call again to get some type of help and answer from an immigration officer….. after such a long wait and all I get is the same ######, FASCES, DUNG, GUANO, ESCREMENT, FECAL MATTER, STOOL, ORDUR, DEJECTION, DROPPINGS, #######, #######, EXCTRETION, BODY WASTE, POO, MUCK, MALENA, any ANY OTHER EXCRETORY PRODUCT FROM ANY BOWEL MOMENT that you think of.. =0(

Do you have an attorney? I believe that an immigration attorney can petition for answers and write and email on your behalf to get answers. I personally belive that your best bet is to retain an immigration attorney and go and tell him everything you know about your case.

I know that when me and Steve where stuck in the hell you are.. we contacted an immigration lawyer (THEY HAVE A SPECIAL EMAIL ADDRESS THAT WE THE PUBLIC CAN NOT USE) he sent an email via that and received a response very soon with lots more information that we EVER got! We also contacted our congressman, within a week we had our NOA2, coincidence? who knows, but it would not hurt to try the above.

Finished for 2 years.

I feel your pain! We are in the same situation since June 2006 (over a year). No one answers you. I've called the 800# all they do is take name, bio data and say don't call back, we'll write you. I requested expedited service and again got no response. I made an INFO pass appointment in August 2007 and the Immigration Officer assisting me told me and I quote: "You need to contact your Senator, they can fix this." What kind of USCIS help is that? I did contact my Senator's office again and they said they didn't have any "magic" to fix this. The Ombusman takes input from all of us requesting their assistance, but again they don't work magic either. What they try to address with USCIS is aknowledging their work backload and lack of consistent service and try to work out an equitable solution. Do you feel like you'll never be reunited on American soil? I do. Patience is a vurtue.....and I don't have any.

You and I have the same time line along with dohbee. That makes 3 of us now on VJ. All of us have recipt notices with the same time frame. I wonder if we are all stuck together on somes desk collecting dust.

Yes we have an attorney but I dont think I retained a brilliant one. She sent a letter to USCIS and the attorney pretty much got back the same generic canned response. see below:

"Based on your request we researched the status of this case. We are actively processing this case. However, we have to perform additional review on this case and this has caused a longer processing time. If you do not receive a decision or other notice of action from us within 6 months of this letter, please call customer service at the number provided below.

If you have any further questions, please call the National Customer Service Center at 1-800-375-5283."

Also our attourney was not really helpful, all she says is that there is nothing we can do but wait. The reason we got her is because she was supposed to be specialized in immigration but at times I think I know more of what is going on with my case than she does. Till this day she was never suggested that we contact any state representative or any thing. When I mentioned it to her after we were way past our normal processing time she said" its too early to contact them blah blah blah thats for extream cases." I was like hello we are way past our USCIS time line. I then decided to do it myself since she was useless. We paid so much money up front for nothing. Then on top of what we had already paid her she sent me a bill for 85 dls just because she wrote (1) letter to CSC asking for an update on our case. She sent only one copy to the CSC in regards to the I-130 and did not bother to send the SAME letter to MSC to ask about the I129F. I mean I dont think it would have been too much of a hassel to change the mailing address to the MSC and change the receipt number as well. When I asked her why did not inquier about our other petition she said "well if I send them the letter that would be another 85." AGGGGGGGG. Any ways some immigration attorney her practice turned out to be. We lost so much money there. Im scared that if I go to another immigration attorney they will tell me the same thing that there is nothing we can do when the case is stuck in background checks but wait. We will just get milked for our money. Any one know of a decent lawyer in Houston that is experienced in cases like this? Well to be honest we don't even count with the funds to get a new lawyer now, thats why I have been contacting the senators and congressmen my self. I guess it's time to start saving again for a new lawyer because its not cheap to retain one.

I forgot to mention that lawyer called me a few weeks ago after not doing so since March of this year. She informed me that she was just calling to check up on me to see how I was doing, and to tell me that she has been checking up on our case online and that still there was no update (DUH no ###### Sherlock Homes)

Any ways Then she said that she was going to give it another month to see what happened and if nothing budged she was going to try to expedite our case.( i dont see how being that we dont qualify under any category to expedite). Then she said dont worry i have a feeling you we will hear something real soon.I dont kneed feelings i need REAL actions. It upstes me that we paid so much in lawyer fees for nothing. I can only hope her feelings are correct.

Ok confused here.

I talked to the lawyer and now she said that she will give it 3 more weeks before contacting USCIS again. Then she said my only option after that would be a Writ of Mandamus. Im confused here as to why she would recomend that. I I was under the impression that USCIS is filing a suit againt all WOM even for people in AOS. Does this lawyer know what shes talking about or are they trying to scam money that I dont have out of me? I dont want to pay money for something that I know is no longer works or is appropiate for my situation. Is there something that I dont know about WOM's? Should we look for another lawyer?
