The simple fact? We're at THEIR mercy. They could decide to take a 3 week holiday and we would have NO say in the situation. We're stuck and they are just playing games with our lives be it intentional or not.

There is no dispersement of mercy form a Governmental agency. There are no 'games'.

No where is this process were you ever promised a date.

Yes, nicely put. Then there are the few like me who actually wanted the AOS processing to be delayed. Had I been a little more courageous, I would have waited just a few more days, to make sure our two applications got smack in the middle of that truck in the parking lot. Instead, I mailed on the 17 for delivery a full business week ahead of the deadline because I knew USCIS would be sending back (in error) for the new fee, a lot of petitions that were sent in time, with the old fee. I didn't want to be one of those.

Now I check the status online dreading a touch.

We don't want the AOS interview before December 1st, in order to avoid removal of conditions later. Already have EAD for both wife and daughter anyway.

FYI, there also seems to be a backlog of entering EADs in the Social Security system, so we can't get the daughter's SSN yet. Fortunately, there's no big rush for her to work.

Well, why didn't you wait? Just curious.

We filed in late July instead of October to save a total of $1130 in filing fees. The EAD was filed before the fee increase date was known.

$1130? That's a pile of money. I don't get the calculation though.

And if you had paid the fees in October (which almost certainly would have assured you missing lifting of conditions) would saving the money from the lifting fee not equalled out?

oh they told me the same thing too when i called up uscis. but then after 3 days from the day i talked to someone from uscis via phone of course, i got my noa already then after a week i got my biometrics schedule. i dont know if they are really telling the truth about the semi truck. i think thats kind of exaggerating...on the uscis site it says that they are now processing applications that was sent august 15. so i think they overcome the backlog now but still say the same thing on the phone...God bless everyone

The Semi-trucks are not an exaggeration, I had the conversation with a contact at USCIS. I can tell you for sure as of Monday of this week CSC still has the Semi trailer and it has not been touched.

That explains a lot. I ran a timeline search today on I-129F applications delivered in August. There is a void in NOA1 receipts between the 8th August and 25th August for CSC.

What is curious is that more people than not who have had applications delivered after the 25th are getting NOA1 receipts.

Two AOS filings. We paid 2X $395 instead of 2X $1010. I don't know if we saved the removal of conditions fees or not but hope we still did, even if I have to employ additional delaying tactics. At this point, I think we're going to be ok. We would have been hard pressed to come up with the $2020 at this time anyway.

Since we already paid both EAD fees before the fee increase date was announced, that was not a consideration in the calculation.

Ah. I get it know. Sorry to be so dense.

Well, even if you DO have to lift conditions later it sounds like you still saved a hundred bucks or so (provided they don't raise it again - which I don't see how they could justify in the next two or three years).

Yes, but we'll do all we can to delay the interview until after November 30. With no touches or movement of the cases at NBC so far after biometrics, I don't expect an interview before December anyway.

Just to confirm the receipting issue I received this reply earlier from CSC:

Dear John Doe,

Your response to our request will be based on the mail receive-in clock time, not based on the data entering time. Thank you.

Sincerely,

Officer C. Chen

Officer Chen,

Thank you for your quick reply.

One more question, our response is due back by October XX, 2007. We have sent it back already. What happens if it does not get entered in time?

Respectfully,

John Doe

Good luck with that. I too was hoping, since they had delayed so long already, that they would delay just a little bit longer so I would get the 10 year card instead of the 2 year card. Alas, my AOS was approved without an interview 3 weeks before my 2nd anniversary(over 23 months) - not that I am complaining about the approval, but I just wish since they were delaying that they had delayed a little longer! I hope you fare better.
