So I sent in the EAD form for my bf before the fee increase since he has a job waiting...figured he could work until married and $180 wasn't too horrible. Well those idiots sent it back to me on Saturday indicating we had not checked the very first box...

requesting a new ead...(which of course is very clearly "x'ed")

i have no idea what to do. i think we are not just stuck until after we get married since his i-94 expires on 10 october and we are getting married on 1 october. so now it will not be until first of the year at best!

18 NOV 2010 Sent 1.8lb packet to USCIS in Laguna Niguel (day 1)

19 NOV 2010 Package signed for V SEMEGI (day 2)

24 NOV 2010 Package returned because USC didn't sign petition (day 6)

calendar reset

26 NOV 2010 Package sent out again (day 1)

29 NOV 2010 Package signed for by V SEMEGI (day 3)

29 NOV 2010 NOA1 issued (day 3)

03 DEC 2010 Hardcopy of NOA received (day 7)

07 JAN 2011 Successful walk in biometrics (day 42) original date 1 FEB

01 MAR 2011 Date on Approval notice (although it arrived after the card did) (day 94)

03 MAR 2011 Card received (day 96)

You realize that by sending in your EAD before you apply for AOS would have only resulted in a EAD card with an expiration date equal to the I-94 (IE.. October 7th). Maybe you just saved yourself $180.00

Ofcourse however he could have had valuable income that would have been able to offset the $1010 AOS fees, $180 clearly would have been well spent. He has a job w/ benefits just waiting for him. Why wouldn't we pay $180 for a full time job w/ benefits. even if it was only 3 months?

What 3 months? In all likelyhood the EAD would have taken 90 days or more to process and in all likelyhood not even received it before the I-94 expired...

well i have seen otherwise...have 2 other friends that are in the same boat and received EAD quickly. was a calculated risk we were willing to take since even 1 or 2 checks would have paid for all the aos fees with some left over.

fwaguy is merely trying to point out that you may have a 90 day wait on your hands and be throwing your money away. You may be lucky...but you may not be and USCIS is very clogged up with applications at the moment after the July fee increase deadline rush.

They have slowed down ALOT lately and your chances, being honest here, are slim at getting a quick turnaround. However, it IS your money and your risk so I wish you luck.
