hmm..definitely check with a lawyer as well. My husband is also applying for oral surgery residencies and all the applications ask for US citizens or perm. residents. We say status pending/other. We know this is a big risk applying when they are asking for citizens or PRs but we dont' want to wait for years till we get the Green Card.

Sigh...I wish we'd get an interview..i'm entering that "depressed" phase again. USCIS told me not to call them till November.

As least with med. residencies most do not specifically ask for citizens or perms as a requirement for applying for residency. best of luck!

Temporary EAD given for 1 month ONLY b/c of Infopass appt: 5/1/2006

Went back to renew EAD through Infopass: EAD card was not given "due to reasons we can't disclose"

5/3/2007: Confirmation that EAD is delayed due to background checks. (started to use the senator, ombudsman and was just a royal pain in the neck)

5/30/2007: EAD production ordered (after over 400 days of waiting!!! woo hoo!)

AOS Interview: 5/12/2008!!! FINALLLYYYYYYYYYYYYYYYYYYY!!!!!!!!!!!!!!!!!!!!!!

7/29/2008: card production ordered...918 days..can't wait to see that card!

No he is already a physician in his country and has passed 2 of the 3 USMLE tests here. He has to serve a 2 year residency here and is applying for that. He will take his 3 test in October. He does not need to go to med school again and I am not sure he has to have his green card to do a residency, but he does have to be here legally, which he is.

He wants to enroll in medical school? You should call the school. Med school is different than just a regular university or college and he might HAVE to be a conditional or permanent resident before he even applies.

7/30/2004 Arrived NVC

8/11/04 Ali received packet from Consular

8/24/04 Ali had interview and was approved

Had to waited 2 weeks for security check

9/15/04 Arrived POE Atlanta

9/28/04 Applied SSN

10/19/04 Recieved SS card

10/25/04 Drivers license (IN requires permit for 60 days)

10/30/04 Married

12/7/04 AOS sent

1/05 Biometrics

5/23/05 AOS interview Approved pending FBI background check

1/06 EAD- (renewed )

AP- applied online took 6 weeks to receive

(we made all the request possible, but were told they could do nothing about how long the FBI was taking)

12/06 FBI background check finished after 2 years

7/07 after 7 months Indianapolis sends request for new bio metrics (made numerous inquiries to NSC and senator)

7/17/07 Bio metrics done again

8/8/07 Received request for further proof of relationship

8/13/07 Bills, photos, letters showing proof received by Indy

9/10/2007 Finally the card production and welcome letter email received

Journeyhelper, I think you're covered. Many hospitals sponsor their residents with H1-B visas which you have no need for. You can put AOS pending which should tell them that they have no need to sponsor him. He has his EAD, etc. he's legal
