Although I got some information from the Juarez thread, I was hoping I might be able to get even more since I have no idea what I'm doing. If we got married in Mexico, do we have to get a divorce in Mexico? Is there any way I can ask for one here in the US? And is there such a thing as annullment in Mexico? I'm hoping someone will know. My only other option is trying to find a Mexican lawyer. :help:

i thnk you can get divorced anywhere. waht might complicate the matter is if the ppl involved are in different countries. in any case do go speak to a lawyer. i am almost positive that there will be some kind of legal clinic in a big city where you can get some better guidance.

good luck.

It depends on your state laws. In most cases you just have to follow the procedures for filing for divorce or annulment for an absentee spouse. Go to your local family court, they'll have a guide book maybe. Otherwise you could go pay an attorney about $1500.00 and let them handle it all. Generally if you file for an absentee divorce, you just have to post it in the local newspaper and he has 30 days to contest, if not, then the court will grant your divorce.

Anyhow, its different by state so like I said pay a visit to your local Family Court or law library theyll tell you waht the real deal is.

Can someone help me to understand the difference between a divorce and an annullment? Thanks...

As for the reasons, I'll talk more about it a little later on...

annulment is usually done within the first 6 months of the marriage, a divorse is done when the marriage has lasted longer than the annulment is good for. annulment is also cheaper than the divorse. id also concider talking to a lawyer about this. you can even call the court house and get free advice on what is better for ya.

woman, if you need someone to talk to, im around. :luv:

an anullment, is when the marriage is erased. as if it never happened. have no idea if that can be done legally, but isn't that what britney spears did with her marriage in las vegas?. i know it can be done via a church.

Read up the "Codigo Civil" (it's online somewhere) for difference between annulment and divorce according to Mexican law - I can't recall the difference right now.... and yes, you can do it in the US as far as I know.

Hope you are ok though, that's what worries me. Sending you a hug.

An annulment is usually only viable if the marriage was entered into fraudlently, like if one of the parties was still legally married at the time, or if one was hiding a criminal record or AIDS or something else that would have made the marriage illegal at the time of the wedding.

Hope things are okay with you.

There are two ways to legally end a marriage – annulment and divorce. An annulment is a legal procedure which cancels a marriage between a man and a woman. Annulling a marriage is as though it is completely erased – legally, it declares that the marriage never technically existed and was never valid. A divorce, or legal dissolution of a marriage, is the ending of a valid marriage between a man and a woman returning both parties to single status with the ability to remarry. While each individual state has its own laws regarding the grounds for an annulment or for a divorce, certain requirements apply nationwide.

An annulment case can be initiated by either the husband or the wife in the marriage. The party initiating the annulment must prove that he or she has the grounds to do so and if it can be proven, the marriage will be considered null and void by the court. The following is a list of common grounds for annulment and a short explanation of each point:

(a reason to use annulment)

Inability to Consummate Marriage – either spouse was physically incapable of having sexual relations or impotent during the marriage

Thanks, this is really good information. I will look up specifics for Maryland. I appreciate everyone's help and concern. I'm doing fine, and this is actually my decision, and nobody did anything wrong...it's just time to move on.
