My fiancé and I have a 2-yr. old daughter together and have been together for 4 1/2 yrs. He is from Ontario (our daughter is Canadian as well) and I am from Colorado. Anyway, my question is should we hire a lawyer to help with the K-1? How many of you have hired lawyers?Was it worth it? Is it easier to just do it out self’s? My fiancé met a guy who said he could do it for 800 and something US$ plus the processing fees, is this a good deal, or a rip off? Thank you, everyone.

IMO - I would say do it yourself. I am using a lawyer currently on my I-130 and I wish I had not. No offense to them, but no one has my best interest at heart more than me. I followed up on my case and think I would have done a much better job than they did. Because of the lawyer's oversight at one stage of this process, it has taken longer for our case to be completed.

This is your birth daughter? Did you register the birth with the embassy so she has U.S. ciziten status?

If you follow instructions well and your case is pretty straight forward, you can do the whole thing yourself, including AOS once your fiancée gets here. Paying a third person is not only expensive but time consuming as well. But if you don't feel comfortable doing it yourself, then just make sure that whoever you end up paying knows what he/she is doing.

If your case is pretty simple, i wouldnt waste the money on lawyers

Thank you everyone. We really don't know a whole lot about the process, etc.

Yes, She is my birth daughter, no we never notified the US embassy of her birth. I have no idea if it would be too late to do so, but I am assuming it is. It has been two years as of The 20th of Sept.

I don't really see any complications with our case, neither one of us have been married, or convicted etc. I make almost 10,000.00 more a year then they request for a family of 3.

My only worry would be I do something wrong or incomplete.

No one here can really tell you if you need a lawyer to help you through this process; only you can answer that question to be honest. Think about where your strengths lay and weigh up the pros and cons.

Some people are naturally good at paperwork and filling in forms, others aren't and need additional help. Doesn't have any reflection on them as people - we're all different and good at different things.

Should we just apply for the dual-citizenship or would it be easier to include her in the k-1? Or do we have to do both? She has been in her daddy’s care since I left Ontario in October after I gave birth. I have visited once since, and he has visited once since.

Since she qualifies for citizenship, she does not qualify for K2. Complete the report of birth with the consulate and get her a passport.
