It is very important to file the I-751 within the correct window of time, and be sure not to file it before the 90-day window. If you file it too early, they will send your application back. You may file at any time during the 90 day window, but it is prudent to file fairly early in the window.

My question is simple- Is this still valid? My wife has a "friend" that's telling her otherwise and has her in a panic.......

You can only file for Removal of Conditions within the 90 day window.... that is the earliest you can file is 90 days before the expiry date on your Greencard and the latest you can file is the day your card expires.... I would not recommend waiting until the day of expiry I would have it mailed as soon as you can once the window opens...

Once you have filed you will get a NOA1 that will extend your Greencard for 1 Year... so idealy you want to get that before the card expires.... the extension letter is good for work and international travel along with your expired greencard...

Forget what your wife's "friend" is telling her.

When you & your wife went for the last interview to receive her conditional greencard, if she was approved, the officer would have stamped the I551 in her passport and handed her a notice with the USCIS logo on the right, which she would have had to sign.

That notice reads ...

"Pursuant to Section 216 of the Immigration and Naturalization Act, you have been granted conditional residence in the United States as of the date that you were admitted or adjusted to such status by an officer of the Immigration and Naturalization service. You and your spouse must file a joint petition to have the conditional basis of your status removed. The petition must be filed within the ninety (90) day period immediately preceding the second anniversary of the date you were granted conditional resident status. If a petition to remove the conditional status of your residence is not filed within this period, your conditional permanent residence status will be terminated automatically and you will be subject to deportation from the United States."

Card expires on: ( its date of expiry)

I-751 send to (your Centre) on (start date of your 90-day period)

signed: (your wife's signature) indicating all has been explained to her

Please submit your I 751 to (name of the center you using) on or about (start date of 90-day). You can download the above form from www.uscis.gov"

Attach a copy of that Notice with your I751 package and you are safely covered as you are acting on their written instructions. Hope the above helps. :) Good luck.

11/17/03 Stepped on US soil again after the long process

12/09/03 Said "I Do"

12/16/03 Began the AOS, AP process

02/10/04 Got AOS & AP;

02/21/05 Applied for 2nd AP & still Patiently awaiting AOS

03/05/05 Got AOS interview date - 05/23/05

05/23/05 Interview. Despite full medical & vaccination and DS-2053 stating everything is Ok on all 3 submitted worksheets, mean officer wants another skin test by a civil surgeon. (I wonder if they're trying to make me ill..?) Next AOS interview is 06/22/05. (West Palm Beach - if an ugly, fat, blonde female officer calls your name; say a prayer!)

06/22/05 AOS Approved; stamp for I-551 in passport. Took 10 mins. (If a pleasant faced female Hispanic officer with light brown eyes calls your name; you're safe; she's professional & kind & seemed surprised that a skin test was asked for.)

07/05/05 Received Conditional Permanent Resident card via mail.

03/22/07 Submitted I751

03/29/07 Receipt acknowledge and conditional status is extended for 1 year

04/09/07 I797 advising Biometrics appointment

04/28/07 Biometrics done

01/31/08 My file got loaded onto the slow boat to VSC

Not everyone has been given that letter.... I did not sign anything after my interview and there are 1000's of people who have been approved without interview and are now at the stage of lifting the conditions...

But thanks for sharing that with us..

True, we were not either as we did not have an interview.....

Thanks all....I will let her read this thread so hopefully she'll stop nagging me! :blush:
