Hey Guys and Girls,

As you can see in my timeline, I received my NOA1 over 4 months ago, and there has been nothing since. The only touches came when the case opened, and when I changed my address (same USCIS jurisdiction). I am worried that I didn't send enough evidence. I was in such a rush to get my I-130 sent off, that i didn't wait for the wedding photos to come back, so i just sent the marriage certificate, 5 or 6 affidavits that know my wife and I and can attest to our marriage, and a copy of a financial statement showing that I added her to my account. Question is: Do you think its ok for me if I send wedding photos now? I was thinking to send them in a new envelope with my case number on each of them and a letter asking that they be included in my case. I am just worried that I see all these people with timelines later than mine getting approved after 2-3 months, and I haven't gotten a singe touch outside of changing my address.

Unless things have changed you don't need the pics. They will come into play at the interview.

well thats good to know. i talked to an immigration advocate who also said that USCIS adjudicators don't place very much weight on pictures for I130 apps (i guess that is why they aren't listed on the form instructions as examples of evidence). She said that pictures only help with I-129f to prove you have met each other before, but with I130, its assumed that you saw each other in person at least once in order to get married. that is why i sent my application without them, i figured it didn't matter much. i just wish i knew why my application seems to be taking forever. I know everyone says that, but I see most people on here had their's approved after 2 or 3 months. i figured at least to have some touches after 4 months

Dont worry mate... have patience.. e all are in the same boat as you are and on the apathy of NVC .... because they have loads of applications.. and cant generate our NOA's and encash our fees on time

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

Try not to sweat it yet, and don't send anything unless they request it. Have you called to check on your case? It's possible an RFE was sent but not received by you.

I just called...California SC is not opened yet, so it transferred me to National Customer SC, and the representative says she can't tell if they sent an RFE or not. She said it just says the same thing that it does online "We received your case and it is now processing..." that the cases say when they're first opened.

I called California SC using the RFE trick, and I got several pieces of discouraging news. 1st is that the officer who answered the phone said they haven't even looked at my case, that they are currently only working on cases submitted at the end of February (which I don't understand since it seems so many people already have had their case approved who filed in March and April, and even a few for May). and 2nd that since I changed my address, that started my processing from May 18th instead of April 23rd. SO BE FOREWARNED IF YOU CHANGE YOUR ADDRESS! I don't know if it had something to do with changing jurisdictions, or because I submitted my application and changed the address very shortly afterward. He just said my case was placed in line as of May 18th...this really sucks, I am very discouraged and disheartened right now

dont be sad,,my i-130 been pending since jan 17-07 and nothing but the first noa..the i-129f been pending since jan and i didnt even recieved the first notice,,,so that should make u feel little better.friend of mine got hes i-130 approved in 3 weeks.

wow mike, that is ridiculous you have had to wait so long. Have you called them because you are out of the processing time window? What do they tell you at that point? Are they any more help in your situation with your wait time beyond their service level goals? I just don't understand the method to this madness. How some people get their papers approved after 3 weeks, and others can wait a year. I'd like to know exactly how they determine adjudication. I know from my service and experience that military members get expedited processing. I would argue that USCIS seems to be the most inefficient, bureaucratic, deficient government agency there is. They even make the IRS and SSA look good

yep,,ur right,,,i dont know what to tell u,,,the same thing always over ur the phone on the 800#,,,we r still processing ur application,,yea whatever,,10 months,,and just to let u know,,everytime u call,,that cause delay's to ur case,,,i got the congress involved and the immigration send me a letter saying that they will research my case and for me to wait 180 days before i call,,so 10 months before and another 6 ,,so thats 14 months waiting for the i-129f ,,and the i-130 stuck too,,,and then the nvc will take another 4 months,,and another 2 months to get ur interview at the embassy,,,that little more than 2 years,,,iam just thinking about jumping the da*** boarder lol,,

hi there,my case took 5months to be approved.i got NOA2 5 months after getting NOA1.and it was at vermont service center.so dont worry and just wait for some more time.and y dont u regularly check ur case status from uscis website.u just need to enter the recipit number.go check www.uscis.gov.best of luck

thanks guys, I appreciate it. Mike, its hard to tell by your words, but you seem pretty calm considering all of that ####### they're feeding you. I think if I were in your place, i'd be going crazy or going to the service centers personally. I am not going to do this at this moment. I am waiting like tamztamz suggests, a few more months before doing anything else, but an immigration advocate at one of these non-profit, community based groups suggesed making an Infopass Appointment to speak to an adjudication officer in person. She says they have the authority to approve or deny your application at the appointment itself, so mike, that may be something you want to consider trying too. like you said, you could always jump the boarder since you in ciudad juarez, lol.

lol,,yea ,,well,,my case is different bro,,,i was legal immigrant in the u.s in 2003,,i have a green card and then my wife and i went together and filed to remove the condetion of my green card,,and then they stamp my passport my passport with the i-1751,,,months later i got divorced,,,and then i got engaged again ,,so ,,6 months later i went to mexico with my new fiance and then when i tryed to re-enter the u.s they denied my entery and i was detained ,,so i got married while i was detained,,and then the immigration judge told them that they made a mistake by puting me in the detantion,,and he dismess my case and droped all the charges,but then he put me back in mexico like i never been in the u.s before and my wife have filed the i-130 for me,,and i been waiting since then,,,and iam not even from mexico,,lol,,,this is my case,,they messed up ,,the judge said how can u guys detain a legal immigrant who have a valid i-751 ?but i dont kno,,things happen sometimes

damn mike, that is absolutely insane. I can't believe that! It shows how much we need major immigration overahaul in this country. It is definitely unnatural for a man and woman who are married to be apart from each other because of the stupid government. I am seriously considering moving to Peru where my wife is to live there until this process is complete. The only problem is that i'm not a millionaire by any means, so i'm trying to get my affairs in order and pay down some debt so I can plan to leave work for about 3-5 months and rent an apartment there. I personally had a meeting with my congressman, and he was really cool about everything and talked to me for about 15 minutes regarding this whole immigration mess we have. Your situation is definitely a lot different. No offense, but I am sure glad that now that I am in the position I am in and not in your shoes. You sound like you have a big fight ahead of you.

thats true and sorry to hear about that,,,yea iam always calm bcoz igot use to it lol,well the bad thing that we'r apart,,but the good thing is that the judge dropped all the charges,,and i have a clean record before,,not even a traffic tickets,,so i wont worry about it ,,the only thing like i said that we'r away from each other and its killing me,,and also my wife have a serious condetion and 6 disks in her back,,and i dont know what to do,,,so hopfully all this will be over soon,,and hopefully the nvc is faster than the uscis in process,,bcoz i dont really wanna jump the boarder,lol
