hello Vjers!

My wife came over on a K1 visa. We have married and filed for AOS. We've had our biometrics appointment and are awaiting our interview. We'd like to get her learner's permit so she can learn to drive, but North Carolina DMV said that she cannot because her K1. They told us we need to wait for her green card. That doesn't sound right to me. AOS can take years! Anybody had a similar experience? I know every state is different, but I welcome all feedback.

05/16/2007 Interview. Embassy requests passport amended. Luckily the turnaround time is two days in Bangkok.

05/21/2007 Pu returns to Embassy with new passport, visa granted. Visa issued the following day.

05/26/2007 Pu arrives in USA!

05/30/2007 Married!

06/26/2007 Overnighted AOS petition to Chicago Lockbox

06/27/2007 AOS petition delivered to Chicago lockbox, signed for by V Bustamante

Driving privileges are a state's rights thing, so the first place to look for that info is your state's DMV office.

All states require SSN to apply, and most require some form of legal presence evidence, Some take the I-94 but will set expiration of permit to that of the I-94, others require Green-Card or at least EAD card before they will issue a driver's license.

From what I read on NC DMV site, they require proof or residency, and SSN before they can issue a driver's permit.

Have you checked NC's DMV site - chances are there are other options and you were misinformed.

...or proof of ineligibility for a SSN. But it doesn't apply to K-1 holders.

Yes, I had the same experience in Oklahoma. I wasn't allowed to get my DL until I had my green card in hand. Other Oklahoma DMV offices allowed others to get their DL when they were presented with a valid EAD card, but the DL was only valid as long as the EAD was valid.

Yes, I had the same experience in Oklahoma. I wasn't allowed to get my DL until I had my green card in hand. Other Oklahoma DMV offices allowed others to get their DL when they were presented with a valid EAD card, but the DL was only valid as long as the EAD was valid.

i am in NC (charlotte) and when i went to the place, i took a bank account page, my ssn, and thats it.

do you have a ssn? with that you can get a bank account, etc..

Claudeth's EAD was good for her but then we decided, after she ran into the Del Taco building, that maybe she didn't need to drive right now :blink:

Same thing is true here in Houston. When we went in with the green card, there was no problem. TX and NC (I'm from NC originally) have the same restrictions for who they give a state ID or drivers license to. And that person must show that they have the right to be in the US for at least 1 year. A Green card will prove that without any doubt.

Our AOS took 57 days and Fernanda also arrived on a K-1. So I would not worry about it taking years for AOS!

Same here, they asked for my greencard. After insisting on the info they had on their website (Louisiana DMV), they accepted my EAD in conjunction with my NOA for my AOS and a copy of my marriage certificate.

I suggest check their website and print out whatever you can find and show it to them (if it's in your favor of course)
