Hi!

I am (almost) going to say that I am 100% happy! I was going to get a job offer for a HUGE company, and I did not hear again from the recruiter.

I have 2 questions!

1. I got my EAD in August. I applied for a job at the begining of august and I was going to get a job offer today but the guy just seems that he froze up the process..why? he started to ask me questions about my legal status, about the EAD, about this, about that..

Do you know if there may be a limitation for a person that has an EAD card to work??

2. my other question is: I did not have any more touches on my cases since a month ago. These are my latest touches:

Does anyone have the same touches? Am i supposed to get my case transfered?

1. Did you apply for a SSN after you got your EAD? The EAD just gives you the right to work but you have to get an SSN. If you have gotten an SSN, there could be a few reasons that you have not heard from this employer. It could be that they are not interested in employing foreign nationals, or even that they are not interested in employing those who are not US citizens because they either do not understand your status or they don't want to deal with your situation. It is unfair, in my opinion, but some businesses are just like that.

2. Touches can mean nothing so don't worry about that. Lots of people get their documents processed without having being touched. USCIS does not always update the online status thing. So don't worry about it! It's going to take you a bit longer to get your green card according to your timeline so be patient.

If that job required permanent residency or citizenship, or some kind of security clearance, then yes, an EAD can have limitations. But they are supposed to state it in the job description.

I'm surprized the recruiter was asking you these questions about the legal status - they aren't supposed to, until you're hired. One has to provide proof of eligibility to work within 3 days of hire - that's the law. What they can ask at the interview is something along the lines of: "Will you now, or anytime in the future, need sponsorship to work in the U.S.?" or just "Are you authorized to work in the U.S.?". Going into details about one's legal status is not common (I can't say illegal - I'm not sure about it).

I applied for my SSN in 1999 (I came here with a j1 work visa, left the country and came back last year, I never visited US again since 1999 until 2006). I applied for AOS in May 2007. They are supposed to deal with foreign professionals every day, it is a big corporation. I will wait till tomorrow. I must wait for him to send me the proposal and if I do not get some news by tomorrow maybe giving a call will help.

The job did not require any kind of security clearance. If hired, I will be assisting customers by phone (by the way, I was not able to apply to more jobs there just because of that security clearance problem!!).

About the phone interview, I sent him a copy of my EAD. Then he called me 3 hours later asking me about the EAD. I think he does not know anything about it. I wanted to give him more information, but I do not want to be rude, or send more information than required. I thought that as a big company, he may be used to sponsor professionals or stuff like that. When he asked for my status, I told him that my status is AOS Pending.

I am afraid that he (by being afraid of dealing with this kind of things..) denies my job proposal or something like that. I hope that he understands that I am not trying to do something wrong. I just have the right, have the knowledge to do it and I just need a job!

I think the recruiter guy had no clue what he was dealing with.

Are you sure you are not getting your job offer? Is there a chance they can still call you? If they don't call you, and you're sure you're qualified for the job, complain to the Labor Board of your state. They can educate the guy about EAD's...

Some jobs are just for US citizens only. Maybe the recruiter didn't know you were only AOS pending until you gave him your EAD. However, it is probably a case of him not understanding the EAD and what it means. You might want to start looking for another job possibility.

ps- have you applied for or do you have your social security number?

EAD is your authorization to work.

Claudeth's petition had some touchs just before she was approved.

I have my SSN since 1999 when I came here with a J1 Visa. After 1999, I did not return here, until 2006. Having that SSN helped me a lot (ID, Bank accounts, etc). The job position did not mention that it is ONLY for US Citizens. (My job if offered, will be being on the phone supporting customers). Also when I was interviewed the Hiring Manager didn't ask me anything related to "papers". Just telling him that I got my EAD was enough.

I am trying to be patient, that is all I can do right now :).

I'm not an expert but I don't know how true that is. Some jobs that aren't with the Feds still require special security clearances and aren't always open to people who are JUST status pending.

I don't have my EAD yet but a while ago I started cehcking job ads out of curiosity and remember that some had "US citizens only" or Permanent residents, which is fair enough.

What I think is NOT fair is that the recruitment agency guy just stopped talking to you. And he is recruiting you for a job position in customer service?!?!?! You would think they'll have enough decency to call back and say at least "Thank you for applying. We are unable to offer you job. Good luck and goodbye!" And you would know what to do. Their customer service here sucks big time!

Good luck in finding a better informed agency, with better customer service skills. And finding a job!

I am still waiting. I got another job offer (with a lot of less money and also less benefits) and I will hold this until I got the final word from the first one (the one on hold because of the legal thing)

I am understanding a little bit more, how the job market works here, how the people is being treated, and what to expect from an employer.

Time will tell.
