Well, about 1 month after submitting the i-130 we have the packet 3 today. Its pretty straightforward however I have a couple questions about it that I couldn't easily find on the forums. (I'm also looking for some P3 contents lists that people have).

I will have a co-sponsor and am wondering what documents they must provide, I am assuming they should provide notarized copies of their last three years tax returns, notarized copy of birth certificate and notarized signed copy of the I-864 (is it I-864 or I-864A for the co-sponsor?). Is there anything else critical for the co-sponsor to send in? Do other documents such as bank statements etc need to be notarized?

Probably someone thats used a co-sponsor before can answer this no problem :)

Thanks a lot, I didn't expect to get the P3 quite so fast, now that its here I feel driven to get it back to them quickly!

Best,

Nick

The tax returns and the I-864 do not need to be notarised. Nothing needs to be notarised really. You do need a official copy of the birth certifcate - the one that you obtain from the county clerk's office. If you're looking at a form that says you need to have things notarised, then you're looking at an outdated form and need to get the newest one from www.uscis.gov. :)

I-864 is for the sponsor and joint sponsor. The I-864A is for household members. I am guessing you are still in China, and in that case, the joint sponsor is definitely a joint sponsor and not a household member.

So from my joint sponsor (my father), I am going a little overboard to be safe and here's what I'm getting from him - signed I-864, past three year's tax transcripts, copy of 2006 W2, copy of 2006 1040, letter from employer, and three recent paystubs. He doesn't need to include any assets, so he's not sending me anything to do with his bank accounts.

Good luck! :)

MargotDarko,

Thanks for the tip on the I-864, I went to the .gov and downloaded the most recent one. I read through (most of it) and I noticed it requested copy of 1040 and W2's for any sponsor. My co-sponsor will have no problem gathering up the copies of the 1040, W-2's, transcripts however I might not be able to find my W-2's, I do however have a copy of my 1040 (filed electronically through HR Block) and I can order transcripts. Do you think my W-2's are necessary provided i will give IRS issued transcripts?

Thanks for you help,

Nick

I am almost positive that when you have the transcript the W2 isn't necessary - I'm going a bit overboard to be safe. It should be that the transcript is all that is actually necessary, but I am a little unclear on what they will need to see from 2006. All that said though, I am quite sure you could contact your employer(s) from 2006 and that they could generate another W2 for 2006 for you.

I don't know how it works in China, but usually the consulate will require certified translations of official documents (birth certificate for instance). I'm sure folks that have gone through China will know more about this.

Margot, I was under the impression that if you have the transcripts, you do not need the W2s - that you only need them if you are submitting the full 1040 forms, right? Just wondering.

Good luck!!!

Peace, L.

Yep, that's my impression too - but I'm not confident enough to say for sure so I'm just taking a copy of my dad's 2006 W2 anyway. :)
