Hello everyone!

I'm gonna ask this question one last time.

Im really really confused about it. By the way this is my wife's account i am using.

So where should i really have to file our K3 petition?

Some people say here to send it to Texas. Some say to Vermont.

Which one really it is? I'm in Forida by the way!

Hi parinita,

I just want to make sure where to send in the petition.

I know in the forms it says that if you live in Florida then the petition should be sent to:

USCIS Texas service Center

P.O Box 850919

Mesquite, TX 75185-0919

But then i heard that Texas SC is no longer accepting petitions for I-129F and K3.

I also got a message from a member here saying that they are from Florida and they

send theirs on Chicago SC.

And some say to send it to Vermont:

Vermont Service Center

75 Lower Welden Street

St. Albans, VT 05479-0001

So thats even more confusing. Dont know which is the proper service center.

My husband has filed for K3 for me at Texas service center and he also lives in Florida.

We filed I-130 and sent it to Texas SC. And I-129 to Chicago Center where i think it says on where to send on that form.

If you are filing an I-129F petition for your spouse, mail your petition to the Service Center where the underlyingI-130 petition is currently pending. Use the address listed on your most recent receipt notice or transfer notice and include a copy of that notice with your Form I-129F.

The other posters here are giving you old information archie. Effective with the new fee schedule as of July 30, 2007, you would file both your I130 and I129F together in the same envelope to Vermont Service Center. See the new direct filing instructions here:

I130s are no longer sent to Texas and Nebraska, but directly to California or Vermont (in your case Vermont).

I was told texas is no longer accepting I130 or I 129f petitions. I just checked the texas service center and there are neither of those petitions listed. I can't seem to find the site with the accurate information.

Unfortunately, the rules seem to be very much in flux right now. There are no published rules about sending the packages together. While the new, published rules instruct petitioners as where to send the I-129F, they don't mention the I-130 at all. In any case, the filing locations listed for the I-129F are specifically related to K-1 petitions. Do not go by these locations. Texas and Florida are supposed to send K-1 related I-129F petitions to VSC, but K-3 petitions from both states seem to be currently handled by CSC.

For K-3 related I-129F petitions, it directs you to file at the location that is handling the underlying I-130. I was told by a USCIS officer(not a customer service rep) to send my I-130 and I-129F packages together to TSC and that they would be forwarded together to CSC. As expected, TSC transfered our I-130 petition to CSC. I received a NOA1 for the I-130 on 9/1. I am expecting the NOA1 for the I-129F. I guess this will be the true test of the acceptance of combined I-130/I-129F filings.

Another recently filed K-3 petitioner I know lives in Florida and had both of his I-130 forwarded to CSC after he sent it to TSC. So I don't think VSC is necessarily going to handle Florida K-3 petitions.

I would suggest sending your package to TSC which is still the designated location for I-130 petitions. If you send just your I-130, you will likely get your NOA1 from CSC. You can decide whether to send the packages together.

You may want to call USCIS and try to speak to an officer. Once you talk to the initial phone rep, you can ask to be transferred to an officer. They seem to be a lot more knowledgeable about the current situation and all the published and unpublished changes.

Also, I just looked at the new I-130 form that was published 7/30/07. It still directs Florida petitioners to file the I-130 at TSC. As I mentioned, it will be transferred to CSC. It seems a bit roundabout, but this does appear to be the current procedure.
