Start collecting aos papers now?

Timeline

is it a good idea to get my sponsor to start collecting the paper work now? we plan on marrying in october, but id like to be able to file right after. I just need to be working and it seems the best way is to get your green card. Im on a k1 and from what ive read the EAD is kinda pointless since you may not get it till after your 90 days is up? or is the ead good past the 90 days?

AOS Timeline

12/05/2007 - Mailed AOS package

07/03/2008 - Received Welcome Letter and Green Card in Mail.

There is not a lot you can gather in advance for the AOS paperwork, but starting early can never hurt.

On the topic of the EAD, this is how it works:

You can apply for EAD before marrying while on a K-1. If applying on the basis of being an unmarried K-1 holder, you will receive an EAD that is valid for the length of the validity of your K-1 visa, i.e. 90 days maximum, after which you can no longer work. Although if you got a full time job while on that EAD and your employer failed to request for your updated EAD after the first one expired, I believe that would be their problem and not yours.

When filing for AOS, you may, at the same time (or at a later time) apply for a 1-year renewable EAD which can be useful if your green card takes a while to process, as you would usually be approved for that EAD before receiving your green card... but you may also get your green card first.

That doesn't really matter anymore with the recent fee increases as the $1010 AOS fee includes EAD and the travel document, so feel free to apply for both just in case, the cost is the same.

I had all my AOS/EAD/AP documents and attachments ready to go before I got married, and then, right after our wedding, all I had to do was attach the certified marriage certificate and pop it in the mail. (We got married on a Saturday, and we mailed the applications two days later on Monday).

We had everything done, except for the marriage certificate, which of course we had to get after our wedding.

May 15/07... 10-Yr. PR Card arrives in the mail

Aug. 21/08... Interview - PASSED!!!!

Sept. 2/08... Oath Ceremony

Sept. 5/08... Sent in Voter Registration Card

Start by getting as many things as you can showing joint ownership. bills or joint registration.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You are talking about the temporary EAD which you can get upon entry into the USA. This is available from only a few select POEs. This is valid for the duration of your 90 day K-1 visa.

After marriage you then apply for the EAD (alongside your AOS) which, when approved, gives you permission to work whilst your Greencard is pending. Sometimes the Greencard will be approved before the EAD.

Actually I was talking about the EAD you can apply for while on your K-1 and before AOS if you didn't get it at your point of entry. It's kind of a waste of time and money considering it expires along with your K-1 visa and you then have to reapply for EAD along with AOS, but that's what I was talking about.
