Travel on K3 Visa

My mom passed away and i need to travel back to South Africa. :crying:

I entered on a K3 visa, which is a multiple entry visa, i am just concerned about the procedure to follow- we just received notification for my biometrics which is scheduled for 19 September. I will be back in time for this.

What happens with the I94 currently in my passport? Do i hand it in when leaving the US? Will i be issued a new one upon my return?

We already received our NOA1 for the AOS, (i will be travelling with this too if it will help)- i really dont know what happens when i re-enter the US? (I dont have another magical brown envelope....)

I751 sent to CSC via express mail with signature request 12/08/09

Infopass appointment to get one year extension stamped into passport 12/14/09 Issued, no problems

Cheque cashed 12/10/09

I797 Notice of action dated 12/09/2009 received 12/16/09

I797 C Notice of action dated 12/17/2009 received 12/22/09

Biometrics appointment 01/14/2010 11:am

"Touched" 01/15/2010

Email received - Card production ordered 03/22/10

Approval letter received 03/22/10, Decision date 03/18/10

03/24/2010 Approval email

03/27/2010 Card received!

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

Timeline

K3 is a multi entry visa. You should not have any problem but for peace of mind contact the USCIS. Im very sorry for your loss.

You shouldn't have any problems. The K3 visa (until it expires) lets you reenter the US even after filing for AOS.

aliens present in the United States in a K3/K4 nonimmigrant classification may travel outside of the United States and return using their nonimmigrant K3/K4 visa, even if they have filed for adjustment of status in the U.S. prior to departure
"The Service will not presume that departure constitutes abandonment of an adjustment application that has been filed."

39. Note that this is quite different from those holding K1/K2 status who are required to obtain advance parole from USCIS to avoid abandonment of their adjustment application with USCIS, if they leave the United States.

I'm not certain what they do with the I94 as my husband hasn't tried to leave and reenter the country yet.

My wife (with K-3 Visa) and her kids (with K-4 Visas) left the country and re-entered again, during this summer. The airline counter took their original I-94's prior to their boarding the plan to depart. They had no problem re-entering. I was worried about their re-entry too. But it all happened smoothly for them.

Just to let you guys know that the re-entry went smoothly.

The POE officer asked me for my brown envelope, but i explained to him that this was my second entry- i guess it helped that i was allowed to enter with my husband in the USC line.....
