Questions about after visa has been approved..

well its finally over and approved... We've been so stressed for the last year over this visa...

firstly was the fact I had a criminal record that required me to have a waiver to visit.. which i applied for over a year and a half ago and still haven't got.. but long story short they said that my charges were not CIMT.. I cant explain to you how i felt at the moment he said "ok, everything looks good"..

now that the K1 is approved will they still say something about the waiver i needed.. I hope i don't need both..

also i'm driving her car insured outta Maryland across the border and I hope this isn't gonna be an issue..

can I work for the first 90 days with my k1 with out the EAD? this stuff really confuses me..

I just wanna make it there for the birth of our son..

The waiver sounds like it was for visiting. If so, your K1 visa app should have shown your record. If it was approved and you have the visa you should be clear.

One of the only POE that issues the temp work stamp is JFK if I remember right. I'd just enter the US when ready, get married, and apply for the work permit during the AOS process.

If the car isn't reported stolen and is registered, then it should not be an issue. You're driving your fiancee's car with her permission. Just make sure her insurance covers you.

If I´m right and you´ve your K1 on your hand I don´t see any problems if you want to begin your new life with her, I mean, all you have to do is to cross the border.

I´ve no idea about your car insurance issue :unsure: , I could help you with spanish cars insurances :devil: but by the time I don´t have so much information of american car insurance´s politics.

And about working with K1 Visa..., as I´ve read here before in another threads, "technically" we can, but at least in my case, when i get there (soon i hope), I won´t have a SSN so I think it´s almost impossibly have an employment without one.

The logical step should be to get there, marry with her as soon as you can, and apply for an AOS+EAD, because during the AOS is been processed, they will "give" to you an EAD (45-90 days after you fill them).

If you are driving across and activating the K-1 there appear to be a scant few of the land POEs that do provide the employment authorized stamp at the border. I remember that Windsor-Detroit Ambassador Bridge is one. You don't say where you are intending to cross the border but if that works for you, you may want to try there. Again, if you are already close to Maryland then obviously it won't be a convenient POE. You could always call ahead where you intend to cross and ask them if they will provide you with the employment authorization stamp with your K-1.

OK SO.....

after reading the above posted I decided to call the Detroit Windsor crossing to ask him about the K1 and the 192 waiver and he said I didnt need it because my visa states on it criminal record reviewed. Not CIMT. i then asked him that if I come even tho they said i need one if it will be ok and he said yes.. even though the guy i talked to at a north dakota crossing said i did need.. but the guy in ND didnt really seem to ask any questions I think he thought i was trying to apply for the K1, but detroit said to come on down with my packet and passport.. and that crimes are continually changing status so maybe a few years ago my crimes may have been CIMT and thats why the border says i need a waiver.. sorry to rant but i just dont wanna pack up and leave to drive 2000 miles for them to say no you need the waiver...

and Kathryn41 you are right i asked and they do stamp ead so i will go that way even tho its a longer drive.
