What paperwork did they give you when they refused you? And what was written on the paperwork? They would have to cite the specific grounds for refusal under the Immigration and Nationality Act. Based on what you stated, it is possible they refused you under 212(a)(1)(A)(iv) - Drug Abuser or Addict.

Also, this would be a good time to seek qualified immigration expertise in the form of a lawyer, and read up on the guides and forum posts.

Drug use is a visa ineligibility and there is no waiver available. Your only option is to wait three years and have another interview.

You also need to make sure you are clear on your consulate's requirements regarding proof of rehabilitation - most consulates require you to prove that you have been in remission for three years since the last drug use and you need to be prepared with evidence that you have undergone drug counseling or similar rehabilitation.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

Salamualaikum,

I am very sorry to hear about your situation. Unfortunetly even if drugs were used as fun and not on a regular basis, the only thing that matters to them is you have drugs in your body at the time of the medical exam. You will have to wait the 3 years and follow the advice some of the others here have given you. You fiance may want to consider moving to Egypt with you until you can reapply.

I wish you both all the best.

The laws in America are very strict on drug usage.

You can not use drugs for ANY reason unless prescribed by a doctor.

You are requesting to become a citizen of a foreign country.

You would want to make your best impression I would think, especially during your interview.

You are lucky it is only 3 years.

You need a lawyer.

Your fiancee needs to find a boy friend who follows the laws.

He interviewed for a Fiance Visa - not citizenship!

You don't need a lawyer - a lawyer cannot change the law or the existing visa ineligibility. But you do need to understand your consulate's requirements for a visa down the road, if you decide to pursue it.

Section 212(a) of the Immigration and Nationality Act reads:

(a) Classes of Aliens Ineligible for Visas or Admission.-Except as otherwise provided in this Act, aliens who are inadmissible under the following paragraphs are ineligible to receive visas and ineligible to be admitted to the United States:

(1) Health-related grounds.-

(A) In general.-Any alien-

(iv) who is determined (in accordance with regulations prescribed by the Secretary of Health and Human Services) to be a drug abuser or addict, is inadmissible.

It is NOT a lifetime ban. The only current lifetime ban on fiance or spousal visas refers to people who have falsely claimed to be US citizens. The law is very clear - he can re-interview in 3 years and needs to prove rehabilitation.

It's always wise to consult an attorney in these situations - but an attorney cannot change this or do anything - they can only advise on the necessary steps to take during the 3 year waiting period and how to keep the approved petition alive at the consulate during that time.

Like they said, just have to wait for three years. Some suggestions to prove at your next interview that you are now drug-free though. Find an outside lab there that does drug testing (one that is credible), and have personal drug screens done on your self regularly through the next three years. Get enough to show that you really are drug-free and not just timing them for when its out of your system. It may cost you to do this, but if you are really commited to being with your fiance in the U.S. it should be a sacrifice you are willing to make. I bet she was mad at you.. i would have been.
