ok,here is what happen...everybody almost know's my story ,,that i was a legal immigrant a,and i was detained bcoz i re-enter the u.s without the re-entry permint,and then the judge dimiss all the charges and i was allowed to withdraw my application for addmition after i got married while i was detained,,so i left the country and then my wife have filed the i-130 for me,,so a month ago we recieved the letter stated that they sent my file from the csc to the local office for standard interview,,so today we recieved another letter from the immigration regard the interview and we dont know what they mean by all this,,and here is what it says(plz submit the items checked below,,and there is bonch of things but the only item was checked is this one...(any documentation which would assist in establishing that you and ur spouse have a valid marriage )and then it says(pursuant to 8 c.f.r 204.2(a)(1)(iii):a visa petetion cannot be approved if the marriage occurred on or after november10,1986 and while the beneficiary was in removal(deportation or exclusion)proceeding... so now whats that mean?like i said i wasn't deported or removal or anything,my case was dismissed and the judge said this will make it look like i was never in the u.s before?so r they going to denied the i-130 or what?whats that mean?r we in trouble or what?iam not worry about proving the marriage,,,we have haundreds of documents that we can prove the marriage?but is this about my previous marriage or the new one or what?iam just going crazy?what's that mean plz?there is 30 items to check,,and they'r not asking for nothing,,exept that thing and we dont know what's that mean?r we gannna get denied?is it about the i-130?or the cr-1 visa?or what?is this for me or for ppl in general who were deported or what?help plz

They are talking about "this" marriage, to your current wife.

Send in ALL required documents.

If you can, hire a lawyer to guide you through the process and of course :guides:, and :time:

Based from your previous posts and history of posts, it seems that you have a lot of questions that needs to be directed to an immigration lawyer. It will be best that you direct them directly to a lawyer, as you will get the best advice and assistance on your case.

Indeed, the best thing you can do is retain an immigration lawyer. Your post is confusing - if you were under immigration proceedings of any kind (removal, deportation, etc.) or if married within the prohibited timeline they are telling you, the visa will be denied. Why? Because it is the procedure in such cases. Again, consult a lawyer who will know way more than we.

hmm i still dont know what time line and what prohbation?i mean what is it to get married again?yes i was detained but i wasn't deported or removal ...the judge told my wife there is no problim,,bcoz they wont be a deportation on my record or anything againts me and i have a clean record,,and he will come back...so now why r thy coming up with all this ?why denied ?when ppl get deported and they deloneys and all kinda of crimes in ther record..they file a waiver and they come back,,why would i get denied if i was never illegal,,never have problim with the law,,never was deported?i dont know wht they r coming up with all this?what is the 1986?and why get denied?..i spoke to a lawyer few months back and he said that ther is no deprtation on my record and no criminal history and not to worry,,so iam confused?

By the way I read both of your posts,

It appears you married while you were in detention.

It also appears they intend to make a issue of the fact you were detained at the time of marrage.

I understand your money problems, because you are stuck in mexico.

But you really need a attorney. I would devote my efforts to getting together that money soon.

If you do not, you will loose this battle.

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!

Mike,

We are not immigration attorneys. We are just talking from our own experience. Your case seems -or your post makes it seem- too complicated at least for me to offer you sound advise. Try to post again with the facts of your case, the reason for the denial, and maybe someone else can give you precise advise. Sorry I cannot be of more help but to tell you to consult a lawyer.

It means what it says "a visa petetion cannot be approved if the marriage occurred on or after november10,1986 and while the beneficiary was in removal(deportation or exclusion)proceeding..."

Whether or not they told you it wasn't a deportation, USCIS is saying it WAS a deportation. If you were married while in removal proceedings, they are NOT going to approve the petition.

You or your wife need to contact a qualified immigration attorney - VJ is NOT the place for you to be getting assistance on such a complicated case.
