At the time you file your I 485 , you will need to provide proof of financial support (I 864) , it is a requirement . I would file the I 485 and provide the I 864 , don't delay filing the I 485 . If you cannot provide the proof of financial support you will probably receive a Notice of Deficiency

All petitioners to adjust status are required to have a sponsor. It's the law.

There's nothing saying that you must file his AOS immediately. That might be the preferred method, but there go the best laid plans of mice and men.

If you can't locate another sponsor (and it CAN be any USC or LPR who meets the income criteria) I'd suggest you wait to file until you can find employment.

I'm kind of worried about you.

How are they going to know you have a problem if he doesn't file right now?

You have time to solve the problem. You have time to find work or find a sponsor. 'They' are pretty busy and don't have the resources or time to discover your problem before you can solve it......................

mi_illusion_st, just make sure he doesn't leave the U.S. or he might not get back in. I hope that you can find a solution to the support problem.

And then when they don't have the proper documentation when they get the RFE, there is a number of days to reply to it within, and if they can't find a sponsor within that time, there's a denial. Bad, bad advice.

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

As long as you married within the 90 days of arrival you are following the rules. So don't worry, take the time you need to grieve, and work on the AOS when possible.

08.2006: Entered with a B-2 visa.

07.06.07: Civil Wedding

07.17.2008 AOS approved with interview. It took 367 Days!

11.08.08: Big family wedding

09.18.09-10.03.09: First trip to France with Hubby

04.19.10: Package sent to Vermont

04.21.10: Delivered in Vermont

04.22.10: NOA date

04.23.10: Check cashed

05.17.10: Received biometrics appointment letter

06.07.10: Biometrics Appointment
