Hello, I have a problem here. I found out that the girl I want to marry has never legally filed a annullment for her past marriage. So I am stuck in the mud here per say. I was all set on going over next month and getting married after I got my divorce finalized. But now I can't do anything. From what I understand, annullments can be a very long process and cost lots of money. Can anyone lead me to some links or to a immigration lawyer who would take pity on a poor man? I really want to spend the rest of my life with this woman, but if I can't get this done it's the end for us since I wouldn't be able to get legally married.

Hi Martin, I'm really sorry to hear that. My brother just went thru this with his fiancee. We found her a lawyer there and the annulment took 5 months and 5000 bucks. The other lawyer we found wanted 4000 and said it would take him 7 months to get the annulment. If your fiancee knows anyone at the city hall where she lives perhaps they can guide her thru this but be prepared to spend some money.

Sorry, but I really can't fill out a time line yet. This might not happen at with a annullment hanging over my head at $5000.00.

Hi I see from your first post that she must have been married for a few month already if not longer, my question is , isnt there a timeframe to file and get a marriage annullment ?

if so wouldnt it be cheaper and faster to just file for divorce based on unreconcilable differances ?

Hi Martin. Sorry to hear about your situation but yes you have to go thru the annulment process to be able to marry your girlfriend.

To those who replied, I am really shocked that the annulment have cost you about 5,000 bucks. That is roughly 230thousand pesos, more or less, which is tooooo expensive. Even lawyers from Manila doesnt charge that much. I believe the maximum expenses would be about 150thousand , and this is if the process is in Manila but in the provinces, the whole process is about 100thousand PESOS or about 2,000K more or less. And , an annulment doesnt get done in just 7 months. It is a long process because it doesnt end after the issuance of the decision.

Anyhow Martin, from where in the Philippines is your girlfriend? Yes, be prepared to spend , its the only way to get her to America. You cant file for a fiancee visa in her favor is she has an impediment to get married. If you are ready, let her file the petition as soon as possible.

And to LONAD. . the girlfriend is from the Philipines, a country that doesnt recognize divorce.

Removal of Conditions :

August 16, 2010 - Petition received by USCIS Vermont Center

August 20, 2010 - NOA1 received

October 4, 2010 - Biometrics

January 3, 2011 - Permanent 10 yr. Green Card Received.

It was 180,000 pesos my brother paid. The rest of the money was grease money to expedite the annulment. Was trying to avoid that explanation but it was completed in 5 months in taguig. The lawyer in makati wanted 150,000 pesos and said he could have it completed in 7 months.
