hi all... i know somebody who wants to bring his family here. he has been here for 13 years (now just starting to think about naturalization). he has a problem though... he lied on his green card application saying he was single when really he was married. i guess this is more common than i think. most likely he did this to speed up the process. what he would like to find out is the consequences of this now that he wants to apply for K3 for his wife and kids. how will this affect his chances of getting K3 visa approved without complications?

i told him to go ahead and apply for naturalization. please give me some input on this.

02.26.09-passport stamped temporary GC.

01.12.09-son's biometrics taken, after 12 months.

12.18.08-still no word from VSC

01.12.08-wife's biometrics taken, waiting for son's appt.

12.19.07-received NOA and EAC#

12.17.07-check cleared my account, cashed on 12.13.07

12.04.07-submitted Form I-751

01.26.06-day 150 (432): son's case approved... no interview. GC rec'd 02/11/06

12.29.05-day 121 (403): wife's case approved... no interview. GC rec'd 01/09/06

11.29.05-day 091 (373): wife's AOS & EAD biometrics done.

11.02.05-day 064 (346): EAD approved, card rec'd 12/05/05

10.15.05-day 046 (328): son's AOS biometrics done

09.09.05-day 010 (292): NOA's received

09.06.05-day 007 (289): AOS & EAD papers received by MSC

08.30.05-day 001 (282): filed AOS/EAD papers

07.12.05-day 233: "JUST MARRIED!"

Once you get your citizenship you could file to bring your wife here. Any other members takes like forever (more than 20 years).

It might be good for your friend to consult with a GOOD immigration lawyer. Someone who really knows immigration. Since he lied on his original green card application, he will have to get good info on the repercussions.

08/19/08: USPS attempted delivery

08/20/08: TSC received N400

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

12/08/08: Interview @ 1:00pm. APPROVED!

Definitely time for a lawyer.

The obvious answer is that his GC will be rescinded and he will be deported.
