I am 23 years and 4 months old. I am getting ready to send out the first package. However, in 2005 I got a drunk driving and in 2002 I got into a few minor cases regarding alcohol and marijuana. All separate cases. One paraphernalia for marijuana. One minor in possession of alcohol. One minor in possession of marijuana. Do I have to really check that box? I honestly do not think 3 will show. I believe that only the drunk driving will show. Even if I do check the box, I will not be able to locate the court documents regarding each individual case. The courts will not have them on file. What should I do? ALSO.............When sending out my first package, do I need to send in any pictures of my girlfriend (I have plenty) or a copy of every page of her passport? Is does not say anywhere that I need to do that. LAST QUESTION...... Do I have to list every job I have worked at in the past 5 years? I mean, I can list the last 3 or maybe 4, but I cannot think that far back and I do not want to attach additional papers if it is more than what will fit! Thanks for the answers

Wow! First of all you have to be honest on your application. If they catch you in a lie I really doubt you will get a visa.

Secondly, I hope you have gotten help for the alcohol and drug problem. I think it would be tough to have a good marraige if you are still abusing those two drugs.

Third. Yes you need to send pixs of your grilfriend. That is, pixs of you two together. I assume you have met.

Fourth, you do need to list the places you have worked. Again, see the first point. Don't lie!

There was an old post (3 years) about this but I can't find it. I think the guy from Mexico was denied for three years and he also had to finish a drug program.

Those cases are in reference to the foreign fiance -- not the USC. My guess is the OP is the USC and isn't clear on whether or not he needs an IMBRA waiver but he needs to provide clearer information.

No, The question applies to me. It is found in the I-129F Part C. Other Information. Question 1= Are you in the Armed Forces of the US. Question 2= Have you ever been convicted by a court of law or court martialed by a military tribunal for any of the following crimes. (Three or more convictions for crimes relating to a controlled substance or alcohol not arising from a single act.

Wow! First of all I am not going to tell you that you have a alcohol and drug problem. That is a little crazy, unless that self-righteous person is a great friend.

Secondly, I only see a ticket for alcohol, and another for marijuana, so I again am failing to see where the drug comes in.

Either or, I also had minor(misdemeanor) convictions for drinking underage(multiple) and getting caught with marijuana(multiple). I am the US citizen here, I don't know if you are, you have not stated that, not even after KitKat offered advice with that question asked. But if so, you do not need a police report. So I did not send one. And got approved no problems. I did not mention that stuff. Your drunk driving which is a felony may be a bit more of a problem and may make them look a little more.

As they have told you do not lie. With your drinking and driving, I do not know what to say to you. Without that I would tell you not to lie, but not to say anything.

The I-129F instructions are quite clear:

What Documents Do You Need to Comply Witht he International Marriage Broker Regulation Act?

If you have ever been convicted of any of the following crimes, submit certified copies of all court and police records showing the charges and dispositions for every such conviction. This is required even if your records were sealed or otherwise cleared or if anyone, including a judge, law enforcement officer, or attorney, told you that you no longer have a record:

3. Crimes relating to a controlled substance or alcohol on three or more occasions, and such crimes did not arise from a single act.

You stated:

#1 2005 I got a drunk driving

#2 One paraphernalia for marijuana.

#3 One minor in possession of alcohol.

#4 One minor in possession of marijuana

Total number of crimes = 4. Therefore yes, you are required by law to check the box and provide the documents

On your other questions, follow the instructions and read the guides.

Like I said to you

I never had a DWI

but I did have more than 3, a few more, and by a few, we will say a few more drinking and marijuana possesions than 3, and I did not submit anything, just ignored it. and I was approved. But that was my individual case only. and did not include a DWI

FYI : A drunk driving is not a felony in the state of Michigan and I highly doubt it is in Wisconsin. If driving drunk was a felon, then 30% of the US would be felons. Almost everyone gets at least 1 drunk driving. The first one means nothing and is very easy probation, the second one is where it gets to be really difficult, expensive, and annoying, and the third drunk driving, you will be screwed for at least 3 years straight with probation and fines.

"The various versions of "driving under the influence" generally constitute a misdemeanor (punishable by up to one year in jail) . However, the offense may be elevated to a felony (punishable by a longer term in state prison) if the incident caused serious injury (felony DUI), death (vehicular manslaughter or vehicular homicide), or extensive property damage (a state specified dollar amount) or if the defendant has a designated number of prior DUI convictions within a given time period (commonly, 3 prior convictions within 7 years). California, which is being followed by a growing number of states, now charges second-degree murder where the legal state of mind of malice exists -- that is, where the defendant exhibited a reckless indifference to the lives of others [7]."

Are you out of your mind? I have never driven drunk, would never drive drunk, and would never associate with anyone stupid enough to drive drunk.

Well I have driven drunk. I have done alot of silly things drunk. I am fortunate enuff not to have a DWI, as for KitKat not driving drunk, that is very very commendable in my mind, as drinking and driving is so so very dangerous, I had a few close calls, and then a friend put me in a coma as I was riding with him and he was drunk driving. So I really do commend that alot.

But yes it is not a felony, of course, or there would be alot alot not everyone, but enuff people that would be felons, and not able to vote also. These republicans out of office.

So anyway, once again I will tell you only from what I went through, I had those marijuana and drinking convictions, and did not state them and we were approved. I did not lie, I just omitted them

I wouldn't say not driving drunk is commendable -- it's smart, it's common sense. There's a reason why drunk driving is AGAINST THE LAW - it's stupid and it's dangerous - not only to the idiot driver and his passengers but to all the innocent people on the road.

Someone who believes that "Almost everyone gets at least 1 drunk driving" has a hell of a lot of growing up to do - really I am SHOCKED at the stupidity level of that statement.

The instructions are quite clear about omissions as well. Keep in mind that an approval based on concealment of a material fact can be grounds of revoking the approval. I suggest you seek qualified legal advice.

http://www.uscis.gov/files/form/I-129Finstr.pdf

If you knowingly and willfully falsify or conceal a material fact or submit a false document with this Form I-129F, we will deny the Form I-129F and may deny any other immigration benefit.

In addition, you will face severe penalties provided by law and may be subject to criminal prosecution.
