We are super close to the interview and now Im starting to double guess everything ive done. I have been unemployed almost throughout this whole process and Im worried that my husbands visa will be denied becuase of it. I have my father who makes well above the poverty line as a household member so he filled out a 1864A but I have no tax return for 2006 becuase I wasnt working and I was living at my fathers. And I cant find anything that officially states why I didnt need to file taxes for evidence. I am freaking out so ANY help/advice would be great! :help:

Sept. 13 2006- Approved and sent to embassy (how before I even fixed the stupid RFE I dont know! And yes I checked with CDJ and they recieved it)

July 9 - recieved emial with interview date

I would think your dad should act not as a household member of your household, but as a cosponsor. This should solve the issue.

And file that return, even if late my friend, even if you had no income...

Don't know if my advise is any good, but my good wishes are 100% proven ;)

Feb 1,2007 - I-130 Reached USCIS.

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

November 12, 2009 - I-751 Sent via USPS Express Mail

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

but you need to file that late return at once..

lower income or not, it is a required paper

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

Does not make any difference at all why (besides that was a rude question). What does matter is that you HAVE TO file those returns ASAP. Otherwise it is highly possible that your petition will be denied. So file my friend, file!

I didn't mean to be rude. Sorry. I was out of country for five months and came back went to school full time so I made little money. Do the NVC people consider this? There was no way I (someone could but not me) could make $17500.

Another question, this is for year 2005. Could I still file for that year?

Again, I just don't know how I can file for year 2005 so please give me some information if there is a way. I would really appreciate it

There was no way I (someone could but not me) could make $17500.

Another question, this is for year 2005. Could I still file for that year?

Again, I just don't know how I can file for year 2005 so please give me some information if there is a way. I would really appreciate it

Yes you can file back 5 years.

With it being that low on the income,

You might get a unearned income credit and make out doing that.

You can pick up forms online at the IRS website or any tax preparer can help you with the form. You indicated you made some money. Therefore you must file. Most likely, you will have no taxes and you will not have any problems. If you do owe there will be penalities and interest. But filing and sending a copy of the filing to the NVC is the most important. If you owe you can always work that out with the IRS. A second thought is that if your parent declared you as a dependent in 2005, then submit that return showing you name and social security number as a dependent to the NVC.

At NVC they check if you are going to be unemployed forever or if the sponsor always lived on social support, that might cause some problems (i can't recall the thread where we talked about this...) but if there is a good reason for being under the poverty line (like going to school) than no problem at all (with a cosponsor)

You can indeed file late tax returns no problem. So go ahead!!!! Attach a letter to your return explaining why you didn't file before (i.e. the taxpayer was unaware of his requirement to file while studying abroad at Cha-cha-cha University of whatever). We had to do that and did not have any problems with the IRS.

"If you were required to file a Federal income tax return during any of the previous three tax years but did not do so, you must file any and all late returns with IRS and attach an IRS-generated tax return transcript documenting your late filing before submitting the I-864 Affidavit of Support.

If you were not required to file a Federal income tax return under U.S. tax law because your income was too low, attach a written explanation.

If you were not required to file a Federal income tax return under U.S. tax law for any other reason, attach a written explanation including evidence of the exemption and how you are subject to it...."
