Hi folks,

My spouse arrived in the US on a K-3 visa a few weeks ago. We're now about to send the I-485 form out. One thing we weren't sure of is if we are supposed to get a medical examination done again and submit it with the form. There was a medical examination form that was submitted to the consulate that issued the K-3 and also a sealed envelope was handed over to the immigration officer and the point of entry.

Does anyone know if we need to get another medical examination done? Or do we just send the I-485 without the I-693 attached?

Thanks much,

-- ABCD

Current status: In the US on a K3, about to file I485

Sand the medical exam is not valid for 1 year from the date of entry.....

If you file for AOS and your medical exam was less than 12 months from the date you are filling then you do not need another medical done... you only need to have the I-693A (vaccination Supplement) done by a Civil Surgeon here in the US....

If your medical was more than 12 months before the date you file for AOS then you need to have a new medical completed along with the I-693A.....

FEDERAL REGISTER INTERIM REGULATIONS at USCIS website, I quote:

"C. Medical Examinations

According to 8 CFR 245.5, aliens seeking to adjust status are required to undergo a medical examination performed by a designated civil surgeon to determine whether they are inadmissible under section 212(a)(1)(A) of the Act. To date, applicants for K nonimmigrant visas have been required to obtain a medical examination abroad pursuant to Department of State regulations at 22 CFR 41.81 prior to entry, and the medical examination is not repeated if they apply for adjustment of status within 1 year of the dat e the examination was performed. They are, however, required to submit with the adjustment of status application a vaccination assessment completed by a designated civil surgeon in order to establish their compliance with the vaccination requirements under section 212(a)(1)(A)(ii) of the Act.

The Service will continue this same policy for the K-3/K-4 nonimmigrants. K-3/K-4 nonimmigrants who file their adjustment of status application within 1 year from the date of the medical examination overseas will not have to submit an additional medical examination. However, the Service notes that applicants whose medical examinations overseas revealed a “Class A” or “Class B” condition (as defined by 42 CFR 34.2( B ) ) must establish upon application for adjustment of status that they complied with those cond itions imposed on the initial admission. Failure to comply with those conditions means that a new medical examination will be required.

My wife was in perfect condition, 2 or 3 hours a day in the gym... I went to Argentina to marry and everything was ok. While I was there we got a head start on the needed shots for the visa. Now she is constant with flu and breathing problems. Wait till the last moments to get the needed vaccines because you have no idea what they made from......... Just a warning!!

Excellent suggestion. Who knows what you will be getting in other countries. Better yet if you can wait until you get to the US.

From what I've seen. Different embassies have different requirements tho.

I just cannot figure this one out. It is right there in black and white. They want an I 693 completed by a civil surgeon. I argued this fact with my lawyer and he said no, we already submitted your wifes vaccination forms from St. Lukes. I thought for sure we would be denied the AOS at thursdays interview . The interviewer had the vaccination form in our file which I saw when he was thumbing thru it. All he asked my wife was the yes/no questions and then asked where did she live. She told him and he said you are approved. He didn't ask to see anything. Maybe he overlooked it and we got lucky but the passport is stamped and he said to apply in two years to lift conditions. I even thought maybe he plays golf with my lawyer. I had a whole briefcase full of paperwork and a photo album and he didn't want to be bothered looking at anything. I'm certainly not going to complain but it's got me baffled.
