Fiance to adjust from F-1 to permanent resident

Hi Guys,

After more research I discovered that this is the forum that I need!

I am soon-to-be engaged to my boyfriend who is here in the US on an F-1 visa (we still have 1 more year of graduate school). His visa will expire in Fall of 2008 (after our June 2008 graduation), and he will still have an additional year to stay here for OPT (Optional Traning, where he is legal to work for a company here in the US for 1 year as an extension of his graduate education).

I was wondering when we should file for an adjustment, and which paperwork we need to file? Should we do this right after marraige, or wait until his OPT runs out (in the fall of 2009) to file?

Has anyone been in a similar situation? I know it is a little premature of me, but I want to know all the steps before we head down the aisle!

I was an F1 student myself and then applied for AOS (Adjustment of Status)...To be more exact, I applied shortly before my OPT came to an end.

I found the guides here on visajourney to be very helpful http://www.visajourney.com/forums/index.ph...page=i130guide2

Basically you have to submit form I-130 (petition for alien relative), form I-485 (adjustment of status application), form G-325a (biographic information) and form I-864 (affidavit of support) along with all the requested supporting documents. If your fiance wants to travel while his AOS application is being processed he should apply for Advanced Parole (form I-131); if he wants to work before he receives his greencard he should submit form I-765.

Your fiance will need a medical exam done by a civil surgeon. In order to find a civil surgeon in your area, use the civil surgeon locator on the USCIS website:

Two more things about the medical exam, "shop" around for a civil surgeon and compare prices...prices vary greatly from about $75 to $200+

Also, try to obtain your fiance's vaccination records from his doctor in his home country if he doesn't have them here with him. He will need to show proof of a number of vaccinations when he applies for AOS.

For people between the ages of 19 and 64 the following vaccines are required:

Td

MMR

Varicella

If he doesn't have written proof of his vaccinations, the civil surgeon will do a titer test.

Another possibility is to ask your school for a sealed copy of his vaccination records on file at the school. This is what I brought to the medical exam (came to US on an F-1 visa myself). If he had already had a TB skin-test done at school (as an international student), he could then ask not to have the skin-test done again at the medical, but instead just have x-rays.

If he is missing any of the vaccinations, it might also be more economical & time-saving to see if they could be had at the school's medical center, so that the vaccinations are complete by the time you go to the Civil Surgeon.
