Sara, I really feel for you. It would kill me if I had to be away from my fiance as long as you've been away from yours. That's why I think even the ones that get married here should have to go back to their countries to wait it out. That way no one would be able to short cut the system.

:ot: Have you tried to call your congress man? I read a discussion in the guides from a former USCIS employee that said congressionals get immediate attention above the rest. I think your case is waaay past the date that a congressional would be appropriate. Hope your day gets better :)

congressmen and senators only get immediate responses not action. I have had senator contact embassy 3 times and only recieved information (document varification) and have talked with a congressmen about contacting the embassy in hopes of getting action, it was explained to me that they cant speed the process for us, only gain a little information as to what they may be doing at the time. At least the information gave me a little peace of mind but not for long. 13 months since I last saw my husband, married for 15 months :crying:

My post said that congressionals get immediate attention not action, and I was refering to the cases still at USCIS. I have no clue how things work with the embassy. I feel for you though. I know how it is to finally find ther person you want to spend the rest of your life with, only to have the US government tell you that you have to wait for an undetermined amount of time.

Be strong and work on the comunication that most marriages are lacking.

i understand that stuff happens and that there are good reasons some might have for getting married while on visitor visa or what ever ..............but the fraud cases or cases of our government on a witch hunt really ticks me off im sitting here over a year waiting for simple k 1 noa2 and someone comes into the usa on an easier visa to either intentionally get a gc.....or create terrorist acts .........to my knowledge no terrorist act has ever been done by someone that is on k1 or any other marraige visa..........why are the people that are real being made to wait so long? does it upset me when i hear stories of people coming on visitor visa or business visa or any other easy visa and getting married and it was planned before they came yes it sure does........perviz could have came on a visa for medical conference or something similar......but we wanted to do it the RIGHT way may God help those of us that try to do immigration the right for the right reasons because our government sure is not

sorry folks im having a really off day today about all of this

sara

Bless you two, you will get what's coming to you and what you deserve soon enough. Just stay strong. (L)

As for the people in the OP article, deport their ### and throw the idiots who did this in jail as they're the reason we have to go through so much trouble to get our SO's here.

I am still dumbfounded by the fact that if you get married in the US on a tourist visa, student visa, etc., you are allowed to stay in the US. IMO it would make more sense the make the spouse go back to his/her country and wait like the rest of us. Why do they get to skip the like just because they got married here? Why can't couples that got married in other countries come here to wait?
I agree. While the underlying relationship may be the most valid in the world, they should have go back to their country of origin and follow the same process as anyone else. They shouldn't be allowed to use a pre-existing visa as a bonus of sorts.

PEOPLE: READ THE APPLICATION FORM INSTRUCTIONS!!!! They have a lot of good information in them! Most of the questions I see on VJ are clearly addressed by the form instructions. Give them a read!! If you are unable to understand the form instructions, I highly recommend hiring someone who does to help you with the process. Our process, from K-1 to Citizenship and U.S. Passport is completed. Good luck with your process.

:ot2: This article makes me mad too. I teach adult ESOL classes a couple times a week and if I had a nickel for every conversation I overhead about visas/immigration/marriage to USCs I wouldn't have to work again - for the rest of my life. One of my students showed us pictures of her trip to visit her sister in NYC. She pointed out her sister in one picture with her husband AND her boyfriend. My student even said that her sister married one guy for the GC, and that the other guy in the picture is her real boyfriend. She said that they took that picture to show immigration that "hey, look, even my sister visiting from FL met my husband." This happened the day of, or day after, our AOS interview. It makes me so pissed! My husband and I went through so much to be together and to hear people talk about AOS interviews as just a way of becoming legal in the country makes me hot  !!!

However, I know there is nothing that I can do about it - this is a business. I just try not to get angry. But :angry::angry: .

Shouldn't there be a place to report fraud? Morally, would you feel it is the right thing to report a fraud of this kind as some would do for reporting benefit fraud?

It drives me nuts to see people abusing the system. They must think that the rest of us, who patiently or not so patiently as the case may be :) wait in the queue to be with our loved ones legally, are complete idiots!

I new here. I've been reading this thread with interest. What are the chances of a fraud investigation in this scenario? This actually happened to me. I met this woman, on a tourist visa, through her cousin(my coworker). We got to know each other in a week. We got a marriage license and a joint bank account. We were to be married in one week from the license application. She wanted a green card and I was doing a friend a favor. It was only after getting the license that I read the forms for filing with the USCIS that I got worried. Especially about the fraud part. So I called off the wedding. I told them I wanted no part of a sham marriage. They were pissed. So the woman left her cousin's house to stay with her aunt in the next town. I later learned that she applied for a visa extension because her visa was expiring in a month's time. But within 17 days of getting the first marriage license with me she went and married another man. I was surprised. I was told that she was going to her home country but in the meantime she met a soldier through her aunt and they apparently fell in love and got married. All in weeks time. So I asked my coworker how can this be? She told me that her cousin was so distraught that she really fell in love this time and it's all legit. I don't buy it. Not only that I learned that the soldier had his so called bride apply for and receive an ID card and medical card. They are also staying at the aunt's house so they are receiving BAH(Basic Allowance for Housing) money which is tax free. Heck she did better for herself than marrying me. Would having two marriage licenses with two different men, getting married to the second man and having filed for a visa extension while doing it trigger a fraud investigation with the USCIS or ICE? With the groom being a soldier he also has to worry about the US Army Criminal Investigation Command. Does getting married on a tourist visa automatically trigger a fraud investigation especially in this case? Is the USCIS so overworked that this will slip through? I guess those women are counting on it. I know the woman's intent is to get a GC and eventual citizenship. Has anyone heard of this happening? I'm not one to report people for flaunting immigration laws and I wouldn't like to be a witness against them in an investigation. Then again the fraud in this is so obvious. Just had to get this off my chest.

I have some experience with this (U.S. military police), just notify CID and the soldier will be swiftly charged under the UCMJ. BAH fraud is a hot ticket item with the DoD. The case will probably trickle over to the civilian authorities from there and she'll get hers too.

I'm sorry USbride, but it makes no sense to me that those who get married here should go back to their countries to wait it out. I have personal experience with someone getting married here and waiting for the GC while here as well as having to go through the situation of being away from a loved one while waiting for the process to take its course. I had a friend who came here on a student visa, working on a degree in a profession that would allow for her to be sponsored by her job to get a GC. So happened that she re-connected with an old flame, who she knew throughout her childhood and they got married. The company was in the process of putting everything together to apply for her, but the process was much faster through her hubby, so they went that route. It would have made no sense for her to pick up and move back to her country to wait out the processing of the application. The fact is, the government has allowed for this, plus they are paying through the nose (as I know you are) to get through this process.

I hope you are united with your SO soon!

Visa fraud just really pisses me off. Because those people not only abuse the system but cause the governments to implement stricter rules all the time which in turn causes us to have to wait even longer... That sucks!

5 years investigation and all they came up with was 50 fraudulent marriages. Wow. That is not very many. They are either very incompetent, or sham marriages are not as common as people think.

They're incompetent. I live in Orlando and know this happens all the time.

Do your part and report them now that you know.
