Can someone remarry right away after a divorce and still get the visa?

I was just curious if someone could remarry right after a divorce and still get the visa to come to the States? This is not for me but for someone I know. Any help would do.

Yes, but depending on which country the beneficiary is from, a visa application immediately following a divorce might raise a red flag.

I've seen plenty of people sail through on VJ who applied as soon as their divorces were final... Of course, as Jenn says, country of origin might make a difference.

It's a middle east country. There applicant is waiting for an interview but it seems as though their marriage is rocky.

I had an immigration attorney tell me that K1 visa process can actually be started right after filing for divorce. He said it was no big deal even for a middle eastern country. But I don't know...

Both beneficiary and USC must be legally able to marry upon filing for the fiancee visa

I know a few gals with ME fiances that filed right after their divorce and their fiances got their visa just fine.

A quick prior divorce would raise suspicions, but if you're able to explain it well with good reasoning, there shouldn't be too much of a problem. Now if you try to keep it on the downlow, they may suspect something fishy.

What I am saying here. Someone in the ME marries an american, then they find out their relationship isn't working, they decide to divroce but no visa has been issued, the petition is at the embassy. They divorce, pull out of the petitions and turn around and marry someone or engage immediately to another american citizen, wouldn't this make the embassy think this applicant is only out for the green card? I would think there would have to be some restrictions, no?

I certainly think it would and should raise questions, but I don't think it means an automatic denial.

These embassies are so flaky, what should alert them often doesn't, and other times they give people a hard time for no reason at all.

orignal petitioner and benif. is on shakey ground. and the Beni is already considering another marriage/ relationship? ####### is that about. can you make the red flag any bigger?

Exactly the same way I see it.

Marrying a USC who submits visa paperwork, then withdraws it and ends up getting divorced wouldn't necessarily raise any red flags, .

But attempting the exact same thing, this second time around through a new USC spouse and so quickly after divorcing the first, would.

Exactly my point. But so many have told her that it can happen. I just can't picture this without a consular saying, wooooooooooooooooooooooooooooooooooe!
