Getting married, about to file K3 but worried about affidavit of support

Hi all ... I am brand new here and to this whole visa process. I've been reading the guides and FAQ's extensively.

I'm engaged to a man from Denmark. We're planning on being married there at the end of this month. After that, when I arrive home I'm planning on starting the K3 process.

I just read this on the Affidavit of Support page and now I'm really worried.

" Just having a co-sponsor may not be sufficient. An actual case has been documented wherein a fiance visa was denied because the petitioning fiance was on government benefits and would not be working, even though the US fiance had two co-sponsors."

I have been on Disability for the past 5 years due to an ongoing illness. I also receive Food Stamps but am not on Public Assistance. I do own my own home but I do not have enough income to be the sole sponsor of my fiancee.

What should we do? We're considering having as many co sponsors as we possibly can. At the moment we have 2 friends who are willing to be co sponsors. But after reading the above, I'm really nervous that it won't be enough.

What happens then, if we are denied? My husband won't be able to be here with me????

07/13/2007--Check cashed.

07/14/2007--Noa-1 arrived in Clint´s house ( Miami ).

11/29/2007--Noa-2 ( by e-mail ) -- After 154 days

I-129F

07/17/2007--Sent I-129F to chicago.

07/23/2007--Noa-1 arrived in Clint´s house ( Miami ).

08/13/2007--Just a mail arrived in Clint´s house tell they transfered our case to CSC.

11/29/2007--Noa-2 ( by e-mail )-- After 135 days

12/21/2007--nvc received!

01/07/2008--embassy received

02/19/2008--interview date!! APPROVED!

02/22/2008--Visa in hands!

02/26/2008--arrived in USA.

03/06/2008--Sent I-765

03/10/2008--Noa-1 arrived in our house.

04/02/2008--I-765 approved

04/09/2008--EAD in hands!

04/10/2008--My husband and I decided take a year vacation of forms, fee, etc...and have a real marriage!

AOS (Finally!)

04-24-2009 - Mailed AOS package

04-29-2009 - AOS package arrived, signed for by N. Brownn

05-04-2009 - Check Cashed

05-07-2009 - NOA'S arrived in the mail.

05-14-2009 - Biometrics letter received

06-02-2009 - Biometrics Appointment

05-27-2009 - Biometrics Done ( Walk-in )

08-20-2009 - Interview - approval after one question!

09-29-2009 - GC delivered!

Filed for K1--> Denied 2005

Married and filed for K3 2006

Got K3 this time --->August 2007

Entered the US-----> September 2007

Waiting to Adjust Status--->..............

Do you recieve more than around $17,150 USD of disability in a year? If you do, you shouldn't technically need a joint sponsor. Disability can be used as income. It's different from unemployment pay and welfare. You can have a maximum of two joint sponsors. My educated guess is that the case the page is referring to was where someone was receiving unemployment rather than disability.

EDIT - Just thought of another thing to say - Income that is means-tested (in other words related to the person's financial situation such as welfare is) can't be included on the I-864. However, the disability income is not related to your financial situation but your health. So, it's not the means-tested gov't benefits that can't be included. So even if you don't have enough disability to sponsor him on your own, you shouldn't run into a problem using a joint sponsor as long as their income is enough and you have all their necessary documents.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
