Hi everyone, this is my first post, and I have a few questions.

I will be returning to the US in a few months, and applying for a visa to bring my husband. Meanwhile, he will be finishing his degree in Mexico. He has another year to finish, so time is not a problem for us. I think the IR-1/CR-1 is the best option for him at this point. Some things to consider:

-I will be waiting to apply for the visa until I have a new job - how will this affect the financial aspect?

-Where can I find out if I need a joint sponsor?

-We will have been married 3 years by the time I apply for the visa.

-Will he be able to visit me in the US while waiting for his visa? He already has a tourist visa.

-Will he have to move immediately after he receives the visa, or does he have a 6-month window?

-will he be able to work immediately after arriving (or after receiving his SSN)?

For IR-1, there is a 6 month window that he can use the visa.

Yes, you can put him right to work as soon as he gets here lol, that is what I am doing with my husband ha ha :lol:

You can find the poverty guidlines in the link above :). Check with the embassy that you will be having your interview at and see how many years of tax transcript ya might need. Some only ask for 1 now, but some still want 3. For a co-sponsor it is going to depend on if you make the 125% poverty guideline.

3/16/06 - Recv'd IV Bill

3/20/06 - Mailed $380

4/20/06 - Mailed I-864

4/21/06 - Mailed DS230 WOOHOO Come on NVC be quick about it...please??!

4/24/06 - NVC Recv'd I-864 and DS230

5/1/06 - Case Complete....... placed on Admin Processing

5/10/06 - CASE COMPLETE THANK YOU LORD!

5/12/06 - Case is on its way to Ankara!!! woohoo!!

5/16/06 - Delivered case to Ankara!!

6/6/06 - Interview!!!

7/27/06 - Ali's Birthday.....FBI CHECKS DONE!!

8/9/06 - VISA IN HAND WOOOT WOOT

9/1/06 - HE IS HERE HE IS HERE HE IS HERE

hi,

Do you have an FM-2 or FM-3 visa for Mexico? If so, you may file your I-130 in Mexico City and save yourself *some* time.

The wait for an IV interview is very long in Mexico right now.. close to one year, and that is not counting petition time, so DCF could be a real timesaver for you. You would need to do this before you leave Mexico.

You do not need to wait to start the application process until you're employed. the first step is a petition, and that does not include any financial information.

He will apply for the visa, not you, not 'we'. :)

He can use his B visa to come to the US, but he will have the usual issues to overcome to actually get in. He is not legally barred from entering.

The visa is valid for 6 months once it's issued, so he can wait before moving.

He will be work authorised at entry.

I recommend that you read the DCF Guide as it has a lot of info for you whether you file in Mexico or the US.
