Hello to All -

I am a new member and quite distressed because my husband and I have got no news from either our I-130 or our I-129F (K3) applications. My husband is a U.S. citizen and I am French. We got married on 19 March. We hired a lawyer who filed our I-130 on 6 April. The NOA for the I-130 was issued on 8 May by the USCIS service centre in California. Our lawyer then filed the I-129F a few days later and the NOA for the I-129F was issued on 16 May by the USCIS service center in Chicago. Since then, we have had no news whatsoever. All we know is that both our applications are pending before the California Service Centre. I check the USCIS website every day and this is becoming really distressing.

At this stage, we are wondering:

a) Whether it is normal that the I-129F has also been transferred to the California Service Centre? We thought that the Missouri Service Centre is handling all K3 application based on the LIFE Act. Did our lawyer make a mistake? Should he have specified on the I-129F application that the I-129F application was in view of a K3 Visa? (not sure he did....)

Is it normal that we still have no developments on either fronts? I saw on this message boards that other people got their files approved earlier in August: what can be delaying our file???

c) We got married in the U.S. and the 2 USCIS applications were filed in the U.S. by our lawyer. Do I have to stay abroad to complete the applications at the country of my foreign residence or can either of these be finalised in the U.S?

Any insights would be most gratefully appreciated! Thanks in advance.

Hi, welcome to VJ.

You are far from alone. First, fill out a timeline here: http://www.visajourney.com/timeline/intro.php

This will give you an estimated adjudication date for your petitions that is a fairly good estimate.

Also look in the K3 forum for the April Filers thread, most of us are still waiting for something to happen. In fact look at the March Filers with NO APPROVALs thread. There are still march filers without approvals, but a whole spate of them were approved over the last 3 weeks, so we can be hopeful that the April petitions will get a look soon. There is also a May and June thread where G&A keeps a great chart of petitions from March forward that is a great tracking tool.

Hang tight, you will get some movement hopefully soon, as will the rest of us with April and May NOA1 dates.

04/16/2007 - Sent I-130 to VSC via USPS Express Mail

05/12/2007 - NOA1 received by snail mail after a loooong wait

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.
