i went to a lwyers office and told them i wanted to bring my husband home. They explained to me the process. I paid them. I took them 4 months to finally send out my papers. I had to call and ask if they recieved the reciept for my papers at least 50 times.... finally after a huge fight with the lawyer the papers were sent. 2 weeks later I recieved NOA1 for I129f petition for fiance.

I just got off the phone with the lawyer she said I didnt need the I130 .... this is not true ...is it?

K-1 (aka Fiance(e) visa (ie.. NOT married) requires I-129F

K-3 (aka Spouse visa) requires I-130 petition first AND THEN an I-129F petition

I understand everyone makes mistakes, even attorneys, but did you do any "checking" on this attorney before you obtained their services? From what I gather by your posts, they filed an I-129 and not the I-130 for your husband. Maybe it's just me, but it took all of 10 minutes to fill out the I-129 and another 10 minutes to gather supporting documents. If it took 4 months for the attorney to file your paperwork, something isn't right. I'd make the attorney fix it and pay all fees associated with getting the correct forms filed. If that doesn't work, tell them you are going to file a complaint with the Attorneys Bar Association in your state....that should put some heat on the attorney to get the job done.

You have not answered one question.... did you file a petition for your fiance or husband?

When did you marry? Did you marry in the US or another country? If you are married, then first the I-130 needs to be filed, then once the I-130 is received by USCIS and you get a NOA1 for that, you send in the I-129. This is the process for Spouse.

For fiancee, it is only the I-129. If you lawyer told you that you only need the I-129 for a spousal visa, they are wrong....and perhaps that is why your intial application was denied, because you did not file the I-130 first.

Please read the guides here regarding the types spousal visas, they are quite self-explanatory and you will be ready with information for when you have to prepare a new application.

Thanks.... I kno she is wrong just from comming on here and reading. She insists she didnt need the I130 and I demanded my money. She said she will give me part of the money back. Their fees only... I am so mad. I will go pick up money from her on Friday. She isnt even the lawyer she is his assistant. The lawyer wont even talk to me he had her handle everything. I am looking up where to report him now. I picked up an I130 form and an 129f form. Now I am back where I started and I have to figure out how to file these forms. This time I think after I have everything filled out... b4 I mail them I will take it to the immigration office b4 it goes in the mail.

You have not answered one question.... did you file a petition for your fiance or husband?

That is NOT true. The I 129f ON ITS OWN is a fiance/e petition. Since you are already married, its no wonder it was denied.

I'd dump the loser lawyer, and either get another one who knows what they're doing, or read up on SPOUSAL visas and do it yourself.

Oh and get a refund from the loser lawyer while you're at it, and also send her the freaking link to our guide here.

They ought to refund you the I 129f fee, too! After all, it was wasted because they filed the wrong damn form, hence the denial. I would definitely be filing a complaint too.

Also, the fees have gone up since you filed originally - you better check out this thread too.

Its $355 now for the I 130 (and no fee for a K3 related I 129f).

What immigration office are you going to take the completed form to? I don't believe local USCIS offices will help you with filling out forms, but I may be wrong.

O I plan on it... By the way I already got that form with all that information today at the immigration office. She gave me a printed out form. I also called the az state bar to make a coplaint they will call me back

Even talking to her after she still is saying she did it the right way... even with me demanding her to tell me how she will compensate if I am told she didnt file the papers right. She still insists she did it right. I have never done this b4 and I didnt research I just went to a lawyer. My mistake ...LESSON LEARNED

Please also write the Arizona State Bar Association, with copies of your paperwork and a copy of the information form from USCIS. If the lawyer's assistant handled this, the lawyer is still responsible. They should be refunding their fees as well as what you paid the government.

I'm sorry for your bad experience.

Especially inform then the attorney himself refused to speak to you and that his 'assistant' appears to be the only person who handled your file.

UNLESS (and you have not answered this question) you were engaged when the petition was first filed and have since married. If that's what happened, your lawyer filed for you correctly.

God bless you sweetie...If you tell the lawyer that you have contacted the AZ state board, etc etc and are filing complaints against them--be ugly--hell, what do you have to lose with the lawyer now??? The people here will help you with everything and you let me know...we can have the papers filled out in a day...just go ahead and tell your husband to go print out the biographic forms and sign them...he needs to get them to you asap....may cost a little bit, but it will save you a little time...also, make sure you have everything from your husband, marriage certificates (in english)...birth certificate (english translated)....just talk to me...and i will give you a list of everything...

oh and guys...yes, she WAS married when she went to the lawyer and told him that she was married...she had no idea of anything else other than what the lawyer was telling her.

I contacted the State Bar, they are mailing me the complaint packet yesterday. :thumbs: I go Friday to pick up a check from the lawyer. I made her give me a time and day. She told me how she was going to be there just for me :blink: cuz she had to be somewhere ... and about how she has to get her child and all this. :angry: I told her ya I understand ... remember I have 5 kids and the drive is at least 40 minutes from my home. She shut up very quickly. I told her the damage caused to my family in unforgivable. She proceeded to tell me how her brother's wife was pregnant and was deported at 6 months, and how do I think that young woman felt.... can u believe this? I said oh really and why. She said cuz immigration is crazy sometimes and something about non payment, she dont kno why they do what they do. She was talking so fast ans went straight into ..... OK Ginger just come in and we will refund ur money.

Ok so when they send back my papers .... it should have all that translated paperwork and all of that stuff right? I was thinking so and the biographic form too. U will help me? Cuz I dont want to mess it up .... he is comming home... dangit!
