RFE question...no paystubs

Hi y'all!!

Was kind of hoping someone on the board would be able to offer any advice (or reassurance!!!) regarding my recent

RFE's.

I received one for myself requesting another copy of my hubbys most recent tax return and employers letter.

Today a RFE turned up for my 8 year old daughter, asking for exactly the same thing, but with an added sheet saying

that as on the most recent tax return, my hubby was under the poverty guidelines, they need employer letter and 6 months paystubs.

Now, firstly I dont know why they requested it for my daughter and not me, but thats kind of unimportant.

I will resend the employers letter which states all the relevant info, i.e that he earns well over the poverty guidelines,

but unfortunately we do not have the 6 months paystubs!!!

I tried to call the mis-information line, but they were pretty useless, just saying that if all the requested information isn't sent, we will probably be denied... (helpful eh?)

Has anybody any experience of this, Im sooo stressed out about this, its doing my head in..

We are in no position to afford a denial ( attourney-wise) and Im at my wits end of what to do..

We don't have anyone to joint sponsor, and my husband earns enough, aaarrrgghhh

08.13.08 Biometrics letter rec. Still no NOA1 (Day 21)

08.27.07 RFE for tax transcript (sent already!!)

08.28.07 NOA1 date, received 09.02.07

09.04.07 Biometrics for AOS & EAD (Day 43)

09.18.07 RFE received by USCIS. Processing resumed.(Day 57)

10.04.07 Card Production ordered EAD..Woohoo!!!! (73 Days)

10.15.07 EAD card delivered in post as well as Approval email

10.15.07 Email to say Im on my way to California!

11.29.07 Card production ordered, still waiting for daughters!

12.04.07 received Green card in post!

Is the salary being electronically deposited into a checking account? Perhaps you can show the bank statements for the past 6 months, w/ the relevant deposits highlited, in addition to the employment letter. Usually on the electronic deposits, the notation shows the name of the company, and that it is "payroll" or something to that nature....so it is clear that it is a paycheck.

Just an idea.

The immigration process is a reminder (sometimes difficult reminder) of the importance of proper records retention!!!!!!!!!!!!

I received the same thing for my step-daughter. I included what pay check stubs I could find, with letter explaining the ones missing and a new employment letter. my salary is above the poverty giuelines, so didn't understand why the RFE would state my 2006 tax return shows my income level below poverty guidelines. :huh:

maybe we have the same adjudicator, who needs a new pair of glasses. :whistle:

Thanks for the advice.

I think I will send in the paystubs we have, with a explanatory letter and another employers letter.

If Uscis, decide this isnt enough, does anyone know whether they would flatly deny or would they then send a letter

requesting a co-sponsor?

We may be able to get a co-sponsor but do not want to approach this unless it is requested.

Also the lack of paystubs was due to flooding NOT lack of proper record retention, thankyou

Sorry to hear you had a flood.... try requesting copies of the missing ones from your employer... they have to keep them on file for 3 years....
