From the USCIS web site

"If you filed a Form I-485, Application to Register Permanent Residence or Adjust Status, on July 30, 2007, or after, then no fee is required to file a request for employment authorization on Form I-765. You may file the I-765 concurrently with your I-485, or you may submit the I-765 at a later date. If you file Form I-765 separately, you must also submit a copy of your Form I-797C, Notice of Action, receipt as evidence of the filing of an I-485."

When you file for AOS, the I-485, you can also sumbit the papers for work authorization, I-765. The fees for the I-485 is $1010 and there is no fee for the I-765 if sumbitting with the I-485 or if the I-485 has already been sumbitted. Is this correct??

Also, from what I see the the AOS takes about 9 months and the work authorization takes about 3 months. Is this correct???

I was just wondering. We just submitted the I-130 and I-129f and will have to do a I-601. I just trying to plan money wise and get an idea of how long my husband will be out of work.

If arriving on K-3 then you will do AOS\EAD @ $1010... If arriving on IR(CR)1 then no AOS is required.

Yes work authorization takes about 3 months but it can vary on the time for a greencard. 9 Months would probably be a good average.

Yes the fees are now $1010 and include EAD(1 yr) and AP when filed together with the AOS papers.

One thing that a K3 can do is file for a EAD seperatly when they first get off the plane which will give a EAD valid for the term of the visa, 2 years. (not sure of the cost for the new fees for this). Problem is that when you then adjust status you still pay the $1010.

It's hard to say how long it takes for AOS to be approved. My husband was approved in 7 weeks but there are people who have been waiting for almost 2 years.

married: jan 5, 2007

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!
