Hey..

I would like to know if it is possible to withdraw I-130 petition. If yes, how would my friend do that?it seems that their relationship, after they got married got worse...and he thought helping her to immigrate to US, where he lives, is not a good idea for the time being. I just hope they can work it out though ...

Anyways, if it is possible to do, is there any impact after the withdrawal?will he be able to file it again just in case they can solve their problems?

FYI, he filed it almost 2 months ago, but had no receipt from the service center yet ...i dont think his check has been cashed as well ...but im not so sure abt it ..

really need your advice ..thank you

I would assume it's possible. However, if he thinks there's any chance of it being resolved within in the next year or so, I would advise against withdrawing it. What he would probably be better doing (until he's sure about what he wants to do) is delaying completing the steps for the NVC. I believe the case can be open for quite a long time as long as he sent something after a couple months saying he was still working on the documents. Someone else should be able to explain how it works to delay at NVC.

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

If he filed two months ago and the check hasn't been cashed, he may not have a petition to withdraw. You can string NVC along for a year or so and it will still be several months before NVC asks for any money. As long as the case is still at NVC, there's no chance his wife will be coming to the USA. Even after it leaves, the petition can be withdrawn.

I agree, that withdrawing the petition now is a bad idea.

I filed a K-1 in the US back in '03, I am now applying by DCF. We just didn't follow up on anything. The embassy didn't say anything about it when I applied with the I-130 and it was on the application. We'll see if they say anything about it at the interview. My situation is a little different though. I was tired of waiting and wanted to be with my husband, so I moved to Europe.

June 1, 2007: I-130 delivered at Embassy

June 1, 2007: Received packet 3

June 10,2007: Sent DS-230 part 1 by email

July 26, 2007: Applied for SVK police cert. at embassy in Warsaw

July 27, 2007: Applied/Received Polish police certificate.

August 7, 2007: Applied for CZK police certificate at embassy in Warsaw

September 5, 2007: Received SVK police certificate

September 5, 2007: Medical examination

September 13, 2007: Received CZK police certificate

September 14, 2007: Emailed form IV/F04 (checklist) to embassy saying we have all documents and are ready for interview.

September 28, 2007: Received email saying they couldn't open the attachment so I sent IV/F04/checklist by fax.

October 10, 2007: Received email confirming they have received fax

October 16, 2007: Received Packet 4

November 15, 2007: Interview, (had to have two police certs translated to English instead of Polish)

November 16, 2007: Two police cert. brought to embassy. Visa approved!!!!!

November 19, 2007: Visa in hand.

March 23, 2008: POE Chicago, IL

It's a good idea to send a notarized letter saying you cancelled the K1.

Could cause probems down the line if you don't.

USCIS required me to do so even after my first K1 was denied.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

hey ..thanks for the reply ..anyways, I found this one from the USCIS site:

(6) Withdrawal . An applicant or petitioner may withdraw an application or petition at any time until a decision is issued by USCIS or, in the case of an approved petition, until the person is admitted or granted adjustment or change of status, based on the petition. However, a withdrawal may not be retracted. (Amended effective 6/18/07; 72 FR 19100 )

so, if they said a petitioner may withdraw at anytime, means, that he or she doesnt have to wait til the NOA1 or what?? if he does cancel, is there any impact to his wife, if she wants to apply for tourist visa and to travel to US as a tourist later? I mean, will her data be recorded in the computer??
