I know of someone who filed for a K1 visa, evidently a K2 was filed also at the sametime, it may have been inadvertant at the tie). The K2(son) didn't go to the interview. The K1 went to the interview and passed and is now in the US.

My question, does the mother need or USC need to apply again for a k2 for the 9 year old son or can they just request another interview for him in China(Guz) ? An attorney is telling them they need to apply again.

Sent I-130 to TSC

Received NOA1 from CSC with a date of 8/15/06

I-130 petition approved 4/16/2008 after 19 months.

Got IIN from NVC 5-13-08

Paid AOS fee online 5-14-08, Paid IV Fee online 5-27-08

Sent I-864 forms 5-27-08

Sent DS-230 forms 5-28-08

6-2-08 called NVC and msg says "received all information,processing will take 4-6 weeks"

6-13-08 called NVC, CR1 is complete, sent RFE for CR2. returned to NVC, waitn on result

6-26-08 case complete/approved. Waiting to be transferred to U.S. Embassy in Guangzhou, China for interview date

7-7-08 Petition forwarded to Guanzhou, China. Awaiting interview letter.

It is my understanding that you can start at the embassy level to have him ' follow to join '.

I don't know if he is required to submit more documents or have an interview because of his age. He will need the medical of course.

All that depends on the embassy, maybe you could contact them and ask to be sure.

Our K1 has turned into a horrendous mess because they insist on DNA testing as paternity proof for immigration eligibility of my fiance's

daughter. The I-129 says to list all children..........we did and marked the box ' not following' NO. Still they insist on DNA.

We had no intention for her to accompany him on his visa and think the DNA test is irrelevant at this time.

They said no DNA, no visa for my fiance.

It was my understanding that all children HAVE to be listed whether they follow or not.............list all children.........it doesn't say list all children

that accompany or follow. That is what the box follow to join is for which we marked NO.

Sorry getting off the subject here.

I am waiting for the response to the congressional inquiry.

Didn't GUZ provide the K-2 with a P3 application package back in April?

If a child under the age of 21 wishes to follow their parent, the K-2 visa must be issued within one year of the issuance date of the parent. It is a simple matter to contact the U.S. embassy in the country and request an interview for a K-2 visa applicant. The process is much simpler than the K-1 but it depends upon the age of the child and the laws protecting children of the individual country. In most cases, legal documents need to be provided showing the ex-husband/wife is giving their child the right to leave the country or death certificates need to be provided. The embassy is usually pretty good about keeping parents and children together. I would start with a well worded email to the visa control section of the embassy explaining the situation including all names, case numbers, visa numbers, etc.

Start now while the weather is still good for traveling. You can move pretty quickly on this and the child could be here in less than two months (assuming the embassy is not too backlogged).

Didn't GUZ provide the K-2 with a P3 application package back in April?

They almost always do. In fact, they are often pests about it. Regardless, they'll send a new set of papers on request. In China, either full custody, permission, or death certificate is required. Full custody alone, is sufficient but the documentation must be a Notarial Translation of a Court Order.
