hey everyone, i am new to the site and i have posted a couple of other questions about stuff that i am concerned about and everyone has been very nice and really helpful.

i have looked through the site but couldn`t find anything as specific as the problem i am worried about, i have one big question about when my fiance and i will file for our K1 visa. the thing is she is a full time student in the US and we are worried that when we fiel for the K1 visa her lack of money will cause us a big problem. she works part time but only manages to make very little. i have quite a bit of money saved up but i know that on the forms it asks for her finances in order for her to sponsor me. her parents however are happy to sponsor me and they are very stable financially, so will the fact that i would have a very stable co-sponsor help me event hough my girlfriend has next to no finances her self? or will we be looked upon as not financially stable? i know that everything changes for the AOS but at the moment i am only wondering about the initial K1 visa part of the financial issues on for I-134.

any help at all or anyone who has gone through a similar situation would be much appreciated.

thanks a lot guys

If her parents are willing to sponsor you and they meet the financial requirements, you'll be good to go. Plenty of people here have been in similar situations, particularly when the USC has been pursuing education, and have done exactly what you're proposing--no worries.

In fact, if your fiancee (who'll then be your wife) is still in the same situation come AOS time, her parents can sponsor you again. The I-134 and the I-864 have different requirements and the I-134 is much more subjective than the I-864, but a lot of people (including me) will tell you that it's best to keep the I-864 guidelines in mind when you file the I-134. The I-864 requires that the sponsor show an income of 125% of the poverty level for the number of persons in his or her household, including the immigrant to be sponsored. Assets can be used to make up the difference if they are convertible to cash within one year and are equal to or greater than 5 times the difference between the poverty level and the sponsor's income.

As well, if you're going through London, we know that they will take into consideration any assets you, the beneficiary, can show. Not income--they don't care if you have a job in the UK or not--but a few thousand pounds in liquid assets are generally looked on favorably by COs in London. Again, this is subjective--I, personally, would most definitely line up her parents as sponsors no matter what your financial situation is.

You should be fine as long as you use your fiancee's parents as co-sponsors (your fiance is the USC right?) Both your fiancee and her parents will need to fill out the affadavit of support for you; your fiancee will be your primary sponsor and her parents will be joint sponsors (or co-sponsors).

Keeping with the thread, at what point in the k1 visa process do they require the "affadavit of support"? Do they require paycheck stubs or will W2's / tax forms be sufficient?

Thanks,

Keith

The affidavit of support is required at the interview phase. Each consulate requires different supporting documentation, but those instructions are usually in packet 3 ( which is mailed to your fiancee from the consulate).

Or, you may be able to find out by clicking on 'embassy info' at the top of the page, or by asking in the region specific part ("Regional Discussions") of this website.
