Hi all,

First, hello to everyone! Im new here... I am a Canadian Citizen living in Ontario Canada with my Husband who is an American citizen living in Canada as a permanent resident. We have been married for over 2 years and my husband has been a resident of Ontario for more than 6 months.

I have read a few things about DFC in Canada and I am confused :wacko: ... are we able to apply by DCF at the TOronto COnsulate? And will this speed up the process at all?

If anyone has any information at all on this I would really apprecaite it!

Welcome to VJ. Yes, you can apply for the first part of the process (called I-130, petition for alien relative) at the Consulate in Toronto in person (no appointment needed as far as I know. The second part is processed through the Consulate in Montreal (where you will go for your interview when they call upon you). The timelines -check my signature- are slow these days. From approval of your I-130, they send you a "packet 3"... then you send it back to MTL, and from the receipt of that one count 5-7 months for an interview date. Hope this helps to get you started.

p.s. As per speeding the process... I don't think even God almighty can do that. MTL is slow, and though they're catching up, they are still s-l-o-w. Sorry :unsure:

Thanks - I had a look at think thread, but it was a little confusing... started with great results and timelines, then had info about no longer being able to apply through DCF after Jan of 07...

Has anyone been able to apply DFC in Toronto after January?

There was a short time when no consulates handled DCF. Most are back to normal now. Why not start by looking at the Toronto consulate website information or contacting them?

Petitioners who reside in Ontario may file an I-130 by mail to: U.S. Consulate Toronto, CONS/IIV, 360 University Ave, Toronto ON, M5G 1S4. The Department of State has limited authority from DHS to accept I-130s from petitioners on behalf of beneficiaries only when both parties lawfully reside in Ontario.

Upon receipt of the following documents we log in, review and email an appointment to the petitioner and beneficiary to both later appear with all the original supporting documents. Walk-in service is unavailable.

Completed, signed I-130.

Petitioner's and beneficiary's email addresses.

I-130 fee of USD 190 in a USD money order payable to U.S. Consulate Toronto. Effective July 30, 2007, the I-130 fee will be USD 355.

Statement signed and dated by petitioner, "I possess, and will present on demand, originals of each civil document contained herein."

Completed biographic data (G-325A) for petitioner & each beneficiary, with passport type photo attached to bottom.

Copies of multiple evidence of the petitioner's & beneficiary's lawful residence in Ontario, Canada, e.g. immigration documents, provincial health card or driving license, lease, utility or banking statements over time. The petitioner must also show a long term visa or other permission from Canadian immigration authorities to reside in Ontario, Canada and have done so for at least 6 months before filing the I-130.

Civil documents that are issued under the original seal, stamp or signature of the government office of record. Notarized copies, religious documents and hospital records are unacceptable. A copy now and original to be presented later:

Petitioner's proof of U.S. citizenship, e.g. birth (www.cdc.gov/nchs/howto/w2w/w2welcom.htm) or naturalization certificate, or passport.

Proof of beneficiary's birth (long version showing parents' information) and of all children of the beneficiary, even if not petitioned.

Proof of legal relationship between petitioner and beneficiary, e.g. birth, marriage, divorce, death, adoption and legal name change. For I-130s on behalf of a spouse, official proof of the current marriage AND the termination of both party's prior marriages.

Complete English translation of any non English document. Anyone competent in both languages may translate, sign and date an attached statement, "I am competent in English and XXX, and this is a correct and true translation," notarization is unnecessary.

Prepaid, self addressed Canada Post Express mailer.

Beneficiaries of approved I-130s will receive IV instructions from: Department of State, National Visa Center (NVC), 32 Rochester Av, Portsmouth NH 03801-2909, http://travel.state.gov/visa/immigrants/ty...types_1309.html. After the beneficiary completes all required IV steps with NVC, NVC will send the beneficary's approved I-130 and IV file to Montreal, which will further correspond with the beneficiary, and eventually offer an IV appointment.

Total I-130 and IV processing time may be 12 months for beneficiary parents, spouse or minor children of U.S. citizens in Canada, who correctly follow all required instructions on a timely basis, longer for others.

We just applied DCF in Toronto. You DO have to have an interview date set up. They don't take walk-ins for it. I also called them to make sure and you have to wait for an appt.

We sent in our I-130 package almost 2 weeks ago. A lady from the Consulate called us Monday to set up an interview date. It is for this Friday. We will go (with all of our supporting/original documents) where we will go through the approval process.

So, yes you can still do it. But you do have to have an interview date.

8-31-2007 Interview at Consulate Approved

9-25-2007 Received Packet 3 in mail

12-9-2007 Received police record (fingerprint version)

1-18-2008 Sent packet 3 back

2-26-2008 heard back from Montreal via email about our interview date

4-23-2008 Montreal Interview!!! Visa APPROVED!!

5-31-2008 Crossed the border into the US to live! :) (one of the happiest days!!)

Currently residing in NC and loving it!

03/2011 Looking into getting dh US citizenship (and just when I thought we were done with all the paperwork! Ha!

This interview you refer to is just for approval of your I-130 - some consulates do not require interviews for I-130 submissions (Calgary for example). After that comes the whole deal with Montreal.- ONLY Montreal issues immigrant visas. The process is, like I said, twofold: first I-130 and approval, then packet 3, your response, and THEN interview in Montreal and Montreal only.

Yeah, that's what I meant :) When I said 'approval process' I just meant approving the I-130 application. I was just trying to tell the OP how it is and what you have to do. Sorry if I didn't word it right.
