Hello everyone;

Our I130 has been approved on May 15th and we are still waiting for the NOA-2. I wanted to ask you if there is somethng we can do about since i saw a case has been approved (They got NOA-1 21/05/2007) on August 10th.

I know USCIS says "first come, first serve".. So what should i do right now? Especially a case which has been mailed after ours and got approved 10 th August.

We got soooo mad and wanted to know what we can do about this. Anyone have an idea what might went wrong or?

I called USCIS and that freakin' automated system made me more mad about it.

From your note above, it is the I-130 that you are inquiring about. Once it is approve, your case is forwarded to NVC for further processing of your application. You can call NVC at 603 334 0700 option 1 then 5 to talk to a live operator. Please have your USCIS Case# handy, and they should be able to answer any questions you may have regarding your case. The best time to call is between 730-800AM and 11:30-1145PM EST.

The thing is it hasn't been approved yet. And i know a case was approved although it's been sent after ours. I am still on the NOA-2 step.

We got NOA-1 15th May

They got NOA-1 21th May

We are still waiting for NOA-2...

They got NOA-2 on 10th August

So what the heck is "first come first serve" thing?

Ok, now I get it... On May 15 you receive your NOA1 which is the RECEIPT NOTICE. NOA2 is the APPROVAL NOTICE and that is the one that you are waiting on right now. Correct?

USCIS is backed up at this time, and depending which USCIS Service Center, unfortunately it's hard to give information regarding how long you still have to wait. You can check what Priority Dates they are currently working on right now. You can also register yourself for email notification at www.uscis.gov on your case and you can see if your case have any "touches" while waiting for the NOA2.

Like I have mentioned on previous comment, fill in your timeline so you know exactly when your case will be adjudicated.

Thank you. I will fill in and letss see what happens from here. I have that account on USCIS web site already and it says it has touched 05/17/2007...

With your timeline, other VJ can be able to help you out easily, and may provide you with specifics base from your timeline. The whole process will sometimes get to the best of you, don't let it! I'm sure there are more of our VJ friends that are in the same boat as you.

You are only talking 18 days.

A lot of factors play into the processing.

Which service center, how well the papers were arranged, weather something is missing, and how hard a worker the case worker who's desk it lands on.

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

wife arriving Nov 18th

WIFE ARRIVED Nov 18th!!!!

That is very true. I have heard also that what country the beneficiary is from also plays a part so you might want to look at member's profiles whose SO is from the same country as yours. It might help you to get a better idea of the timeframes, etc.

It's hard to give an estimate on how long it might take for them to approve your petition. Our took 89 days but we have been really lucky. There are a lot of people here that had their NOA2 after 120 or 150 days, I don't want to sound negative but it's a lottery and I did not understand all the factors that play a role in the approval process.

Thank you guys. It just doesn't make any sense to me since i have seen "first come, first serve" ####### on USCIS's web site. At this point-sadly to say- there is nothing we can do other than waiting. Anyway, I hope you guys get this freakin' visa done sooner than you expected.
